Uganda - Deregistration of a Community Based Organization (CBO)

- To deregister a community based organization (CBO) one has to make an application with the District Non-Governmental Monitoring Committee in the district.
- The application for deregistration shall be done on Form M which is provided at the District Non-Governmental Monitoring Committee Offices.
- The following documents are required to accompany the application for deregistration of a Community Based Organization, -
- a copy of the constitution of the Community Based Organization to be deregistered;
- a recommendation from the Sub county Non-Governmental Organizations Monitoring Committee indicating that the CBO has been in operation in the sub county;
- a work plan and budget or strategic plan for the Community Based Organization showing activities in the community while in operation; and
- Proof of the certificate of registration of a Community Based Organization during the period of operation in the sub-county or district.
- After arranging the above document follow the first step before visiting Nongovernmental monitoring committee at the District.
Step 1 :
- Hold a meeting seeking deregistration of the CBO members.
- Prepare the minutes of the meeting seeking deregistration of the CBO , this should be endorsed by at least 2/3 of the members.
Step 2 :
- Visit the Sub-county’s Nongovernmental monitoring committee offices, Sub-county’s Public Service , in your respective sub-county to make a formal written application with the respective officer.The officer will recommend you to the district for further process.
- Pick Application for deregistration from the Non-governmental monitoring committee at the District.
- Here you will be given the DEREGISTRATION FORM FOR A COMMUNITY BASED ORGANIZATION to fill and submit.
- Fill the Registration Form and attach the following Requirements:
- Official letter from the CBO.
- Original certificate.
- Minutes from CBO with reasons of deregistration signed not less than two thirds of the members.
- List of Members names, ID Nos and Signature.
- Recommendation letter from Sub-county’s Nongovernmental monitoring committee officer.
Step 3:
- Obtain the Acknowledgment of Deregistration
- It takes one day to be deregistered. If approved, an acknowledgment of deregistration is issued by the Nongovernmental monitoring committee at the District.
- Where the DNMC refuses to deregister a CBO, it shall give reasons for the refusal in writing and notify the organization of its decision within 30 days in Form M.

Need for the DocumentEdit
- The de- registration officially removes the CBO from formal recognition and listing in the government records.
- A CBO needs to be registered for it to carry out its operations in Uganda. After registration, the CBO is given an operating permit, which allows them to operate in Uganda.
- When one ceases to make non-taxable supplies.
- The de-registration of a CBO may occur when one changes the nature of a community based organization to a taxable nature of business or through legal re-categorisation of supplies, from exempt to taxable.
- It can also be through winding up of business.
- The CBO organization voluntarily applies for deregistration or if it is wound up.
- Decline to submit turnover reports to NGO bureau.

- A CBO should be de-registered in the Sub-county it resides .The de-registration offices are located in all sub-counties in the country around the country.
- From the definition of a CBO, it is clear the organization is expected to work beyond one sub county and where it is necessary for a CBO to work beyond a sub county, it should apply for extension of area of coverage.
- A CBO does not have legal personality and does not require an elaborate process of dissolution. A CBO can be dissolved in accordance with its constitution or governing documents.
Other uses of the Document/CertificateEdit
- Legally de-registering of the CBO gives the CBO legal protection from future obligations in its name.
- Where the District Non-Governmental Monitoring Committee refuses to deregister a Community Based Organization, the District Non-Governmental Monitoring Committee shall give reasons for the refusal and notify the Community Based Organization of its decision within 30 days.
- The notification shall be in Form C.
- The District Non-Governmental monitoring committee may refuse to deregister a CBO, where the persons applying for deregistration of the organization gave false or misleading information.
- The proposed name of the CBO is the similar to that of an existing NGO or any entity operating within the same district; or
- The proposed name of the CBO is confusing or undesirable.
