Uganda - Apply for the Grant of an Exploration License

To “explore” means to define and determine the economic value of a mineral deposit.
Apply In-Person

  1. The application for an Exploration License should be made to the Commissioner in the form prescribed.
  2. According to the Mining Regulations, 2004, Section11(a), an application for the grant of an exploration license under section 26(a) of the Act shall be made to the Commissioner in Form II as indicated in the Regulations.
  3. Visit the office and obtain an application for exploration license from the concerned department.visit their website on the following Link
  4. Inquire from the officials at the office about the documents to be attached with the completed application form. Complete the application form as required with relevant information and details.
  5. After completing the application form with respect to the need, attach the required documents with the completed form.
  6. Also pay the prompted fees as required. After that, your application form and documents attached will be forwarded further for various processes of verification and validation.
  7. The Commissioner grants the Exploration License according to Section 27(1). According to The Mining Regulations, 2004, Section 3(1), the grant of a Exploration license shall be in the Form XIX as indicated in the Regulations.
  8. Section 30 establishes the duration of an Exploration License as not exceeding 3 years. while renewals are to be of duration not exceeding 2 years for a single period.
  9. Once all the processes are done and documents are found in order, your application will be approved and an exploration license will be issued with prior notification.

Required DocumentsEdit

  1. Valid prospecting license is required
  2. Submitted Profit Loss returns to prove that you have an appropriate program of work.
  3. Map of desired area at 1:50,000 scale
  4. Work program for the exploration operations to show that you are likely to be able to finance the proposed work and any rehabilitation.
  5. Project brief to prove that you are a fit and proper person to hold a license.
  6. Executed form II fill in order to notify the public of your intentions and provide the opportunity for objections.
  7. Adequate financial competence of the applicant in exploration business.
  8. The original and two copies of the application to the Commissioner.
  9. Proof of payment of and of deposit for cost of experts
  10. The applicant may also refer the application to other agencies for comment and advice of any land and heritage protection issues.

EligibilityEdit

  • Applicants should be persons intending to invest in the business of prospecting for minerals or mining in Uganda.

FeesEdit

  • Registration Fee 500,000 Ugx
  • Mineral rent 50,000 Ugx per km2 per annum
  • Gazetting grant of EL 300,000 Ugx

  • The Validity period is usually three years and then renewal is required.

InstructionsEdit

  • No exploration license shall be granted over an area of land that is the subject of a mining lease, a retention license, or a location license.
  • Section 31(1) of the Act confers on the Exploration License holder the exclusive right to carry out exploration operations in the area relating to the license.
  • According to Section 28(1) of the Act, no exploration license shall be granted over an area of land that is the subject of a mining lease, a retention license, or a location license.


Required InformationEdit

  • A person who intends to obtain an exploration license shall submit.
  • Name, address and nationality of the applicant.
  • In case of a body corporate, the corporate name,registered office address and country where it is incorporated.
  • Names,addresses and qualifications of potential principle contractors and supervisors to be employed for the project.
  • Description and location of the project,amount of investment capital,technologies to be used, site and construction plans.
  • The estimated date of completion of the project.
  • Environmental project brief or environmental impact statement in the form and with the information prescribed by the Environment(Environment Impact 4 Assessment)for further processing.
  • The description of safety programmes,equipment and plans for the protection of occupational health,industrial safety and environmental protection during regular construction operation as well as contingency plans for accidents,natural disasters and emergencies;
  • A Tax Identification Number for new investors and tax clearance certificate for existing companies.
