Apply Online
- To Register a Trademark, the applicant has to make the application online via the following link
- Click the “Proceed to ETM file” text and it will direct to the basic information page.
- To begin the online registration, select the language you prefer for your application by clicking the “Language” drop-down menu.
- Next, you will need to select the type of mark you are applying for by clicking the appropriate box
- As an example, we will try to register a word mark (represented using words, letters, numbers or any other characters that can be typed)
- Complete the rest of the form. Once you are done click the “Next” button
- the goods and services page will display. On this page, you will be asked to indicate what goods and/or services your trademark protects. Click the “Search” button to open the pre-accepted list of categories
- Scroll through the list using the scroll bar on the side (Encircled in RED). Tick the box opposite the appropriate category of the goods/services that your mark protects.
- In case you don’t want to go through the pre-accepted list of goods and services, you may opt to provide your own list by clicking the “I want to provide my list” button
- Choose the class of goods/services that your mark protects and then type in the specifics of your chosen class of goods or services. When you are finished, click the “Done” button
- You will be redirected back to the goods and services page. To move on to the next step, click the “Next” button
- This is the priorities page. On this page, you will be asked to declare if you would like to claim priority by clicking the “Yes” or “No” boxes. When you are done, click the “Next” button to go to the next step.
- The next step is providing details about the applicant. Click the “+ Applicant” button
- Fill in the applicant details form. First, indicate whether the application is being filed by an individual or a business/company. Use the drop-down menu to go through the “Applicant Type” list.
- Complete the rest of the applicant details form
- After completing the applicant details form, click the “+ Add” button.
- In case the application will be filed by a representative, the representative details form must also be completed. To open the representative form, click the “+ Representative” button.
- After you have completed the forms, click the “Next” button
- Then the confirmation page will display. Go over your application once more before finally submitting it for processing.
- On the same page, you will be asked if your business falls under the small entity category. You will also be asked to tick the boxes that correspond to the specifics of your application.
- Also, you will need to provide the name of the payor and any additional details about the payor on the box
- After you have completed and reviewed the form, click the “Submit”
- You will be directed to the payment page where you will be asked how you would like to pay for the application fee. Once you have paid the filing fee, an acknowledgement receipt will be generated. The acknowledgement receipt is your evidence that the application was received by the IPOPHL. The receipt contains the Application Number and Filing Date.
- Your application will be formally examined by IPOPHL. A substantive examination will also be conducted by the Office. Your application will be published for opposition for a period of 30 days.
- Once approved, a Certificate of Registration of the trademark will be issued to you. Also, the IPOPHL will publish the newly registered trademark to inform the public.
Apply In-Person:
- To Register a Trademark, the applicant has to approach the Intellectual Property Office of the Philippines link
- An application form will be provided to the applicant by the concerned officer. Or the applicant can download the application form from the following link
- The applicant has to fill in all the necessary details in the application form. (Incomplete applications are not accepted)
- Make sure that the applicant has attached all the necessary documents that are mentioned in the “Required Documents” section of this page.
- The applicant has to attach the photocopies of the required documents along with the application form while submitting.
- Submit all the documents with the completed form to the concerned officer.
- The applicant has to pay the prescribed fee to IPOPHL cashier as mentioned in “Fees” Section of this page.
- After receiving the application, the concerned authority will check the submitted application and document set. If all are in place, the application will be accepted.
- An acknowledgment receipt will be provided. Please save it for future reference.
- Then the application will be processed further. All the updates on the application status will be sent via SMS to the applicant’s mobile number.
- Once the verification process gets completed, the applicant will get a call from the office.
- This entire process can be completed within 15- 30 days or as per the timeline advised by the respective department authority.
