ProcedureEdit

  • The state government will make announcement about the granting composite (prospecting) licence-cum-mining leases through auction by method of competitive bidding. The prospective applicant shall look out for the announcement.


Apply In-Person:

  1. Based on the announcement or as per the identification of such opportunity, the applicant shall approach the respective office of the assistant director of mines and geology (ADM & G) of their respective district in whose jurisdiction the area falls as appropriate. If the application is accepted through bidding method, then please find the steps explained under the “Bidding Process” section below.
  2.   3. Please visit the respective office and consult with the designated authority about the application procedure. Collect the application form or write on a plain A4 sheet as advised.
  4. Complete the application form. Attach all the required documents as per the “Required Documents” section of this page and submit the application form in 3 sets along with the documents to the designated receiving authority in person.
  5. Please pay the applicable application fee, survey charge and deposit amount as per the acceptable mode (demand draft/challan). Please refer to the “Fees” section of this page for more details.
  6. After receiving the application, authorities will check the application and document set. If all are in place, the application will be accepted.
  7. Authorities will make entries about this application in the manual record or electronically using the computer and provide a record number for reference.
  8. The authority will also sign and seal one set (photo copy of the original) of the application and return it to the applicant. This signed application is also the proof for the submission of the application.
  9. Please keep them safe for future reference.
  10. Applicant will be informed of the probable date of getting the sanction along with other timeline for mandatory activities.
  11. ”SMS” triggered update on application status will be sent to the applicant’s mobile. So, keep track of the notification from the department.
  12. This application will be processed further. The application will be examined by the respective department.
  13. The application will be forwarded to the concerned tahsildar or the concerned authority for seeking the classification and availability certificate (NOC).
  14. On receipt of the “NOC”, the assistant director of mining and geology or the designated authority will inspect the area along with the concerned surveyor for demarcation of the area.
  15. Based on the above activities, a proposal will be submitted to the issuing authority as applicable.
  16. The issuing authority will evaluate the proposal and issue “Letter of Intent (LOI)” to the applicant. The “LOI” recommends the applicant to submit the “Approved Mining Plan (AMP), Environment Clearance (EC) and Consent for Establishment (CFE).
  17. The applicant should obtain these above-mentioned documents from the department concerned and submit them to the designated authority as per the “LOI”.
  18. On receipt of the above documents from the applicant, the issuing authority will grant the order.
  19. The status, viz. Approval will be conveyed to the applicant through a “SMS”.
  20. Please follow the notification and guidelines of the department.
  21. Following the grant, the lease will be executed within 90 days from the date of grant in case of category 1 minerals and 60 days in case of category 2 minerals.


Bidding Process

  1. The applicant shall approach the respective office of the assistant director of mines and geology (ADM & G) of their respective district in whose jurisdiction the area falls as appropriate.

  3. Please visit the respective office and consult with the designated authority about the bidding requirement. Please obtain the tender document from the authority and pay the applicable document fee.
  4. Complete the tender application form. Attach all the required documents as per the “Required Documents” section of this page including the documents listed under the ‘’Documents required for participating in the auction” and enclose them in an envelope.
  5. This envelope can be submitted directly at the concerned office as per the authority's advice (in 3 sets) or can be sent through registered post (in 3 sets). The submitted application is referred as a technical bid.
  6. Once the tender application is submitted, the applicant will get an acknowledgement (for postal submission, an acknowledgement will be sent to the address of the applicant by post). Please keep it safe for future reference.
  7. Only those bidders who are found to be eligible, whose initial price offer is equal to or greater than the reserve price, referred to as “technically qualified bidders”, shall be considered for the second round of auction.
  8. The highest initial price offer amongst the technically qualified bidders shall be the “floor price” for the second round of auction or online electronic auction.
  9. The technically qualified bidders shall be ranked on the basis of the descending initial price offer submitted by them and the technically qualified bidders holding the first fifty percent of the ranks or the top five technically qualified bidders, whichever is higher, shall qualify as qualified bidders for participating in the second round of auction or electronic auction.
  10. Once the timeline is fixed for the second round of auction, the qualified bidders shall submit their final price.
  11. Once the department finds the suitable bidder with the highest final price, the preferred bidder will be declared to conclude the auction process.
  12. The winner of the bid should furnish performance security (0.25% of the value of estimated resources).
  13. The State government shall issue a letter of intent to the preferred bidder. The preferred bidder shall be considered to be the “successful bidder” upon:
    • Compliance of all the terms & conditions of eligibility.
    • Obtaining all consents, approvals, permits, no-objections and other relevant approvals for commencement of prospecting operations.
    • Submission of scheme of prospecting.
  14. Upon fulfilment of the above, the State government grants a “Composite Licence” to the successful bidder.
  15. Please follow the notification and guidelines of the department.
  16. Following the grant, the lease will be executed within 90 days from the date of grant in case of category 1 minerals and 60 days in case of category 2 minerals.

  • After the execution of lease, the lessee (leaseholder) shall submit “Consent for Operations (CFO)” before the commencement of quarry operations or within 6 months from the date of grant for category 1 minerals and 2 years from the date of grant for category 2 minerals.

  • Bid letter in the format specified as per the tender document
  • Bid security in form of a bank guarantee for an amount mentioned in tender document
  • In case of bidder being a company, a power of attorney (notarized) in the format specified in the tender document authorizing the signatory
  • An affidavit (notarized) in the format specified in the tender document
  • In case of bidder being a company, duly certified copy of the corporate authorization (notarized), such as board resolution to participate in the tender process and submit a bid
  • Notarized copy of PAN card of company and PAN card of authorized signatory
  • Net worth document
  • No dues certificate, which shall not be older than 6 months, from the respective mining engineer / AME under whose jurisdiction the bidder holds or has held mineral concession or revenue collection contracts of the department
  • Memorandum of articles & certificate of incorporation if the bidder is a company & partnership deed & firm registration certificate if bidder is a firm
  • In case if an applicant is a subsidiary of another company incorporated in India, then the holding company has to submit an undertaking stating that the applicant will continue to be subsidiary of holding company until such time, the applicant meets the minimum required net worth threshold
  • The copy of GST receipt paid by bidder on purchase of tender doc

EligibilityEdit

  • Applicant should be a citizen of India.
  • Those who are 18 years and above are eligible to apply.
  • A firm (members of the firm should be the citizens of India).
  • The area covered by composite licence/lease shall not be less than one hectare, but not exceeding fifty hectares or as per the respective State norms.



FeesEdit

  • The fees and charges vary across the States in India. Please pay the application fee, processing fee and other charges, as prescribed by the authorities at the time of application.
  • Application fee Rs. 5,000 or the applicable amount through treasury or bank challan or as advised.
  • Deposit amount of Rs. 10,000 or the applicable amount as advised per hectare.
  • Every prospecting licence holder shall pay prospecting fee of rupees fifteen thousand and rupees twenty thousand for colour granite and black granite respectively and rupees ten thousand for marble per hectare per annum.
  • Demand draft obtained in favour of the assistant director mines and geology of the district concerned in whose jurisdiction the area falls.
  • The application fee and deposit are subject to revision from time to time.



ValidityEdit

  • The period for which a composite licence or lease may be granted shall not exceed three years.
  • A composite licence shall, if the state government is satisfied that a longer period is required to enable the licensee to complete prospecting operations be renewed for such period or periods as that government may specify. Provided that the total period for which a prospecting licence is granted does not exceed five years.

InstructionsEdit

  • No mining lease shall be granted by the state government unless it is satisfied that, there is a mining plan duly approved by the central government or by the state government, in respect of such category of mines as may be specified by the central government, for the development of mineral deposits in the area concerned.
  • Incomplete application will be rejected.
  • Avoid spelling mistakes while filling the application form.
  • At any stage, if the document submitted by the applicant is found to be false, then the licence/lease issued shall be liable to be cancelled.

Need for the DocumentEdit

  • The composite licence or lease is required for those areas where the preliminary exploration has been done by the government, but further exploration is required by mining companies.
  • No person shall undertake any mining operations in any area, except under and in accordance with the terms and conditions of a mining lease, granted as per the act and the rules made thereunder.

  • The deposit is refundable to the unsuccessful applicants. In respect of applications in whose favour the licence is granted the deposit amount shall be adjusted towards security deposit and the balance, if any, shall be refunded.
