Procedure

Apply In-Person:

1. An application for the Inter-State Workmen registration of an establishment (principle employer) shall be made to the office of the designated Registering officer (local labour officer) of the area in which the establishment sought to be registered is located.

3. Go to the respective office.
4. Meet the respective authority at the office. The applicant shall get the advice from the authority to be followed to apply for this certificate.
5. Collect the application form from the authority Or write on a plain A4 sheet as advised.
6. Application form can also be obtained using the following link: Link please refer page number 6.
7. Complete the application form. Attach the entire required document as per our “Required Documents” section. Also, include a crossed demand draft showing payment of the fees for the registration of the establishment.
8. Please submit the application document in triplicate to the designated receiving authority.
9. The application shall be sent by registered post to the respective office.
10. On receipt of the application, authorities will check the submitted application and document set. If all are in place the application will be accepted.
11. Authorities will make entries about this application in the manual record or electronically using computer.
12. An acknowledgement receipt will be issued for the application received. The same will be sent as Email and as SMS to the registered email ID and registered mobile number respectively. Please save it for future reference.
13. This application will be forwarded to the respective department for further processing.
14. Applicant will get update about the progress of his/her application through SMS in their registered mobile number. Applicants are advised to follow the department guidelines to get the certificate.
15. After scrutiny by the designated authority, short fall in the documentation if any will be intimated through SMS along with the date of inspection.
16. Authorities will inspect the premises and clarify their queries. The outcome of the scrutiny of documents and inspection of premises will be recorded as a report.
17. The Application along with report will be forwarded to the issuing authority concerned.
18. If the application is found to be correct in all respect, the issuing authority will grant a Certificate of Registration of Establishment as principal employer with his/her seal and signature.
19. The status, viz. Approval or Rejection if any will be conveyed to the applicant through an SMS or as per applicable norms.
20. The Certificate thus granted shall be hand delivered or sent through post to the address mentioned while applying or can be downloaded online as per applicable norms.

Apply online through state portal

1. Go to the online portal: online portal
2. In the given page please click “Inter-state Migrant Workers Act (Principal Employers)” option under “ONLINE REGISTRATION / LICENSE SERVICES” section to reach new page.
3. In the new page please click “Amendment in registration of principle employ” button.
4. A new page will be provided. Please select “Apply for amendment in PE registration for Already Offline Registered Application(on or before 15/01/2016)” option.
5. Applicant will get online application form page. Please fill in all the relevant details as per page prompts and click “Save Details & Upload supporting documents” button at the bottom to reach next page.
6. Please upload required documents as per the page prompt and click the appropriate button to move on to the next step.
7. Please make necessary payment by using the on screen option.
8. Finally submit the application online using applicable button.
9. A system generated acknowledgement will be provided along with docket number and the same will be sent as Email and as SMS to the registered email ID and registered mobile number respectively. Please save it for future reference.

Apply Online

1. Please go to: online portal
2. In the given page, please click “Registration & License” menu.
3. A new page will be provided. Please go through the onscreen information and use the “Click Here to Register” button at the bottom to get the next page.
4. If you are a new user then click “Sign Up” option provided in the top right corner to get Sign up page. Please complete the prompts as applicable and click “SIGN UP” button to get authentication instruction.
5. As per the instruction user shall access the mail sent for authentication. Please use the link sent to your mail id to reach a welcome screen.
6. In the welcome screen please use “Click Here” button to authenticate.
7. In the resulting page please enter the captcha at the prompted space and click “Generate OTP” button to receive OTP in the registered mobile number.
8. Now enter the received OTP at the respective prompt and click “Verify OTP” button to get “Set User Id and Password” prompts. Please complete the given prompts as applicable and click “Submit” button.
9. A “Registration Successful” pop up will be provided. Please click “Ok” button to reach login page.
10. Please use the login credentials as applicable at the given space and click “LOGIN” button to log in.
11. A information prompt will be provided. Please use the close icon to close the pop up.
12. Applicant will reach the dashboard.
13. Please use the “Registration for CLC” option provided under “Registration” on the left part of the screen to get the list of establishment and relevant details.
14. Now click “Apply for New Registration” button in the top right corner to get the next page.
15. Here, select “Interstate Migrant Workmen Act…” option under List of Acts and click “Submit” button.
16. Applicant will get online application page as per selection.
17. Please complete the respective sections (Principal Employer Details | Establishment Details | Work Permit Details | Work Place Details | Manager Details | Contractors Details | Contract Work Details) with applicable details as per page prompt as appropriate. Applicant shall use the “Next” button for each section to move on to successive sections.
18. In the “Attachments” section please upload applicable documents as appropriate and click “Submit” button.
19. Applicant gets application number as acknowledgement and the same will be sent as Email and as SMS to the registered email ID and registered mobile number respectively. Please save it for future reference.
20. This application will be forwarded to the respective department for further processing.

Note:

• If the application is found to be incomplete / incorrect, then the application is rejected with a reasoned reply to the applicant.
• This registration is applicable to every establishment in which five or more Inter-State migrant workmen (whether in addition to other workmen) are employed or who were employed on any day of the preceding twelve months.

Eligibility

• The applicant stands ineligible in case of the applicant…

Fees

• Security deposit at the rate as advised by authorities for each workman to be employed as Inter State Workmen shall be deposited.

Validity

• Every license granted is valid for the period specified therein and maybe renewed from time to time for such period and on payment of such fees and on such conditions as may be prescribed.

Instructions for the Agencies about using UC module in PFMS:
Agencies will have to enter & upload the UCs in PFMS portal besides sending it in physical form to their respective Program Division.
The below mentioned steps may be followed for entering and uploading the UCs in their PFMS Account:

1. Login into Login by entering the “Username” & “Password” then select the year and then click “Login” and open your PFMS Account.
   
2. Go to Utilization Certificate module of PFMS.
   
3. Enter Utilisation Certificate details of current fiscal year as well as previous fiscal year’s for the various releases made to him and then submit.
   
4. Generate GFR19 (UC).
   
5. Manually sign the UC.
   
6. Upload the UC.
   
7. Approve the UC
   

Processing Time

• This registration process will be processed in 15 days from the date of receipt of completed application form.

Instructions

• The certificate is non-transferable.
• The inter-State migrant workman will be entitled to a displacement allowance and a journey allowance in addition to his wages.
• The number of workmen employed as inter-State migrant workman in the establishment shall not on any day, exceed the mentioned numbers as per application.
• The fees paid for the grant of the license shall be non-refundable.
• The rates of wages payable to the workmen shall not be less than the rates prescribed for the schedule of employment under the Minimum Wages Act, 1948, where applicable, and where the rates have been fixed by agreement/ settlement or award, not less than the rates fixed.
• No principal employer of an establishment to which this Act applies shall employ inter-State migrant workmen in the establishment unless a certificate of registration in respect of such establishment issued under this Act is in force

Need for the Document

• If an employer engages / employs / recruits any person by or through a contractor from another State (home state of employee) under an agreement or other arrangement for employment to their State (host state for employees) then the employer must register as per the procedure explained here for a Certificate of Registration of Establishment as principal employer.
