Procedure

Apply In-person

1. Any person intending to get the declaration or declare as owner or occupier of a building, shall apply to the respective office of the concerned designated local authority (Municipality / Town Panchayat / Village Panchayat) as appropriate in which the land is situated.

3. Please go to the respective office and consult with the designated authority about the applying procedure.
4. Collect the application form or write on a plain A4 sheet as advised.
5. Link to download application form: link please scroll down and click the “FORM K DECLARATION BY OWNER-OCCUPIER” form option to get the form.
6. Please approach a licensed surveyor/architect or the concerned authority to measure and survey or make a necessary assessment of the property.
7. Complete the application form and get the licensed surveyor/architect or the concerned authority attestation as appropriate. Attach all the required documents as per the “Required Documents” section of this page and submit them to the designated receiving authority as advised.
8. After receiving the application, the authorities will check the submitted application and document set. If all are in place, the application will be accepted. Please pay the required fee/charges as per requirement and don’t forget to collect the receipt.
9. Authorities will make entries about this application in the manual record or electronically using the computer. A record number will be given as acknowledgement for receipt of the application form. Please collect it and keep it safe for future reference.
10. This application will be processed further.
11. ”SMS” triggered update on application status will be sent to the applicant’s mobile. Please follow the department notification.
12. Inspection will be made by the department as per requirement. On a scheduled date, the concerned authority will inspect the premises and make verification of the facts as per the application form.
13. Based on the inspection and evaluation, the concerned authority will consider the applicant’s application for a declaration of owner/occupier.
14. The status, viz. Approval or Rejection (if any) will be conveyed to the applicant through an SMS.
15. Please meet your local authority office once again and follow their guidelines to complete the process.
16. This process is helpful for the grant or sanction of many services with respect to the building.

• Notarized affidavit by the applicant
• Applicant’s Residence proof (ration card / Passport / Aadhaar card / Driving licence)

• Self-attested copy of sale deed/lease deed/power of attorney
• "FMB"/ Town Survey sketch or Patta/ Chitta/ Town Survey Land Records (TSLR) in owner’s name

• The latest property tax receipt
• Encumbrance certificate for 13 years issued not prior to 30 days from the date of submitting the application
• Aadhaar card

• All original and copies of original with self-attestation as advised by respective authorities to be submitted as per requirement.

Eligibility

• Applicant should be a citizen of India.
  
• Those who are 18 years and above are eligible to apply.
  
• The owner/occupier of the Land/ power of attorney holder/leaseholder is eligible to apply.

Fees

• Please pay the charges as appropriate at the time of processing.
  
• Authorities will provide fee details at the time of processing.
  
• Please pay for the stamp charges as appropriate.
  
• Please pay the charges as applicable for the licensed surveyor/architect.
  

Validity

The declaration is valid as long as the land is not sold to someone or subdivided.

Need for the Document

This process is required for those applicants who are in need of any building-related permissions.
Every owner or occupier of land, who intends to construct a swimming pool or a new building or alteration, extension or addition to the existing building or change of use of the building or to safeguard the asset from the hands of illegal occupants, should obtain the authentication from the concerned competent authority by following this procedure.
