Honduras - Register a Marriage

Procedure[edit]

For marriages held in the country:

  1. Go to the municipal registry to register the marriage.
  2. Submit application form along with all other required documents.
  3. Once the authenticity of the documents are verified by the officer, he/she will register the marriage in the book of Marriage in the Civil Registration System .
  4. The officer will then print the certificate of registration of marriage , this will give the respondent the opportunity to review all the information in the registration certificate.
  5. After reviewing all the information on the registration certificate, the officer will sign the document to formalize the applicants registration.
  6. The marriage certificate will be printed and issued to the respondent , as proof that the procedure was successfully completed.


For marriages held abroad:

  1. Obtain a certified marriage certificate extended by the registry of the country where the marriage took place.
  2. Submit the certification to the authentication process (Apostilled) officer of the country where the birth occurred.
  3. Have the authentication and certification translated to the Honduran consular authority accredited by that country.
  4. Authenticate the signature of the Secretary of RR . EE . to the Ministry of the Interior and Population.
  5. Certify to the Secretary General of the RNP that the signature of the Secretary of Interior and Population in the document is authentic.
  6. With the certification of Marriage duly authenticated , the person to perform the registration shall file an application to the Directorate General of RNP.
  7. Go to the municipal registry to register the marriage.
  8. Submit application form along with all other required documents.
  9. Once the authenticity of the documents are verified by the officer, he/she will register the marriage in the book of Marriage in the Civil Registration System.
  10. The officer will then print the certificate of registration of marriage , this will give the respondent the opportunity to review all the information in the registration certificate.
  11. After reviewing all the information on the registration certificate, the officer will sign the document to formalize the applicants registration.
  12. The marriage certificate will be printed and issued to the respondent , as proof that the procedure was successfully completed.

Required Documents[edit]

For marriages held in the country:

  • Photocopy of Identity Card of the contracting parties .
  • Certification of birth of the parties, with the observation that the registration bears no marginal notes amending its state.
  • Consent granted to minors, it may appear in the record, statement or by the child's parents or age of contracting writing signed by the grantor and notarized .
  • Extended Certification by the Registry setting forth the dissolution of the link marriage if any, of either or both spouses.
  • Statement from two or more witnesses attesting that the parties have the legal capacity to get marry, it must be in writing and accompanied by photocopies of identity cards of witnesses.
  • Medical certification issued free by doctors serving in the various state health departments or otherwise for any medical facility.
  • Proof of Publication or edicts waiver granted by the Secretary of Interior and Population


For marriages held abroad:

  • Certified marriage certificate extended by the registry of the country where the marriage took place.
  • Proof of Identity, birth certificate

Instructions[edit]

Civil marriages or unions can be officiated by the Mayor, Notary Public Lawyer or competent judge. Marriages must be registered with the Municipal Civil Registry where the event was held to be considered valid. Deadline for registration is fifteen (15) days after the event.

Recognition of de facto union can also be registered with both interested parties appearing before the Mayor or notary , making verbal or written statement of its intention to formalize their relationship and presenting the documents and data required for the celebration of marriage.

Where to register marriages and unions:

  • The Municipal Mayor or notary authorizing the civil marriage or who recognizes the union, is required to transfer the file containing the documentation of merit, to the Civil Registry of the place where the event was held , within fifteen (15 ) days for registration. If the union actually originated from a judicial act, the court shall provide a copy of the judgment, at the same time without prejudice to the legislation of the country where the event was held.
  • Hondurans or their spouses may register directly with any Civil Registry in Honduras , presenting the duly authenticated documentation. The diplomatic agents or consular officers, are required to submit quarterly to the Office of the National Registry of Persons (RNP ), list of marriages registered under their offices for the period.

Need for the Document[edit]

Marriage is a legal contract binding two people together, granting them rights and obligations. For purposes of the constitution of the family, Honduran law recognizes civil marriages and unions. Both are based on equal rights and obligations of both parties and both must follow the requirements and formalities established by the Family Code.
