Chhattisgarh - Register a Foreign Power of Attorney

ProcedureEdit

An NRI or an OCI residing outside India wants to sell / purchase / rent out / take possession of a property located in India but unable to visit India and register the property in the Sub-registrar office shall execute the power of attorney through following steps.

Apply In-Person:

  1. The principal person shall approach the respective Indian Embassy / Indian Consulate in the foreign country where he/she resides.
  2. Link to locate the Indian embassy or consulates in other countries: online link please use the country name as appropriate from the Alphabetical order for respective contact details.
  3. Please call them using the contact number to fix an appointment. One can get advice for their requirement over the phone based on the availability of the executives. This will help in getting any latest updates on applying norms.
  4. Please approach a Notary Public authenticated by the respective Indian Embassy / Indian Consulate present in the country where he / she resides.
  5. After consultation, the foreign power of attorney (Special power of attorney or a general power of attorney) will be executed on plain papers as per requirement and Notary authentication will be made.
  6. Once the foreign power of attorney is ready, please organize other set of documents as per our “Required Documents” section.
  7. On the scheduled date, go to the respective Indian Embassy / Indian Consulate office for attestation with foreign power of attorney, required documents and your valid identity documents. Please take two witnesses to sign before the authorities. If the witnesses are not present at the consulate, you can get their signature and notarize them.
  8. Meet the respective desk authority and provide your appointment details. On clarification, the desk authorities will direct you to the appropriate section.
  9. Please submit the entire documents in two sets to the designated authority. The authority will verify the documents and clarify the details.
  10. From this point onwards please follow authorities guidelines to complete the applying process. Once the process is complete, you will get the foreign power of attorney attested after being registered.
  11. The registered foreign power of attorney shall be delivered as per applicable norms to the executor.
  12. This power of attorney shall be used by the executor (power of attorney) for further processing on behalf of the principal person.


To process in Sub registrar office

  1. With the foreign power of attorney attested by the respective Indian Embassy / Indian Consulate on hand, The executor shall get the Power of Attorney (POA) registered with the office of the registrar (Deputy Registrar Office) which has the jurisdiction over the area where the property is located or as advised.

  3. Please approach the Sub registrar office and confirm the date for registration.
  4. Procure stamp paper for registration of Power of Attorney (POA) as per the arrived/advised value.
  5. on the scheduled date agent (power of attorney) and witnesses should go to the registrar office and wait for their turn.
  6. On their scheduled slot, please follow as per authorities guidelines to process.
  7. Please produce your ID in original before the registrar.
  8. After verifying the details in-person, the registrar will sign the respective order.
  9. Agent (power of attorney) and witnesses should sign the registry as well as in the advised places of the document to finish the registration.
  10. This stamped/ registered foreign power of attorney will be delivered as per applicable norms as notified.
Note:
  • All the powers that you are delegating must be clearly stated in simple words.
  • All of whom involved in registration must carry originals of ID proof and address proof at the time of registration.

  • Electricity Bill OR Tax Receipt of the Property (if POA is related to some property)

EligibilityEdit

Both the executor and agent must be of legal age and mentally competent to execute such a document.

FeesEdit

  • Registration fees and stamp duty are not same across all the states and UT’s in India.
  • Please make arrangement for the stamp paper for registration as advised / as applicable.
  • Document preparation charges are the other charges incurred.


ValidityEdit

  • Power of Attorney executed abroad and authenticated by an Indian Embassy should be stamped and adjudicated within three months after receipt in India.
  • A POA always become null and void upon death of principal or on the expiration date specified in the document.
  • A POA is valid till the purpose for which the power of attorney is granted, is accomplished.
  • A POA is valid till the power of attorney is revoked / cancelled by means of a registered cancellation deed (as the power of attorney relating to the property is registered).

Need for the DocumentEdit

  • A person residing outside India need to execute POA to an agent in India to sell/buy/rent out/ take possession of his or her property on his absence.

  • An agent appointed as Power of Attorney (POA) shall make decisions in case of disability or illness.
  • It is compulsory to get the Power of Attorney registered in order to use it as legally acceptable evidence before the court.
