Apply In-Person

  1. To obtain a mining license, the applicant should also have to apply and obtain a Prospecting Licence (Refer to wikiprocedure website for full procedure, on how to obtain the prospecting license), upon obtaining the prospecting license, the applicant should visit the Department of Mines office, which is under the Ministry of Mineral Resources, Green Technology and Energy Security. (Contact details listed below).
  2. Applicants are required to complete the Mining License Application Form V (a), forms are available for free at the Enquiries Desk at any of the offices of the Department of Mines, or directly download it using this link Link
  3. Submit the duly completed application forms along with the relevant attachments (mentioned below under the ‘Required Documents’ section) to the Department of Mines, section concerned to be verified by the attending officer.
  4. The officer will then verify, if all the necessary information and documents have been provided and that the applications comply with the selection criteria, if everything is in order, the application file will be registered and recorded and you will be issued with an acknowledgment letter containing details of the application
  5. Your application file will be forwarded to the General Directorate of Mines office for evaluation and recommendation by the component departments, who carry out an investigation study on the site to evaluate the impact the mining activities will cause on the environment and the neighbouring communities and write a report and its recommendation.
  6. The recommendations retained during the site investigation will be taken into account as per the development and exploitation plan of the site, the environmental protection program, and the groundwater for the rehabilitation of exploited sites.
  7. The application file, the investigation study reports, and recommendations will then be sent to the interministerial commission, who will be convened to further assess the feasibility of the requested service.
  8. If the commission is satisfied that all the conditions as set for obtaining the mining license are met under the mining act, your application will be approved and you will be issued with the signed and certified line by the minister, after payment of the required license fee and against the acknowledgment slip and your identification document.

Required DocumentsEdit

The following documents must be submitted in copies of four (4)

  • Completed Application Form V. If the application is submitted on your behalf by a consultant, the applicant should include a letter naming the consultant as their representative. The applicant should include their postal address, telephone, and fax numbers.
  • A certified copy of the company registration certificate or Certificate of Incorporation.
  • Prospecting report approved by Department of Geological Surveys or a copy of prospecting waiver including retention or mining license of the holder.
  • Diagram depicting total area, coordinates and planned development of prospective mining location, and an archaeological clearance certificate from the Department of National Museum, Monuments, and Art Gallery.
  • Detailed feasibility report containing:
    • Details of mineral deposits, including all mineral resources and reserves (measured, indicated, inferred, probable, and proven) and mining conditions.
    • A technical report detailing mining and treatment options and intended operations.
    • The proposed program of mining operations, which should include the estimated date by which the applicant intends to work for profit, initial position(s) of the quarry (quarries), coordinates of surface rights, estimated recovery rates, nature of the product, and proposed sales and marketing arrangements.
    • Environmental impact assessment study and proposed environmental management program.
    • Capital investment and cash flow forecasts and details of the anticipated financial plan.
    • Proposed number of employees and employee training program.
    • An outline detailing proposed sources of goods and services.
    • Details of expected infrastructure (e.g., access roads, electricity, and water supply).
    • Clearance from the Department of Wildlife and National Parks, if development is within a game reserve or national park.

EligibilityEdit

Applicants should meet the following criteria;

  • Citizens and non-citizens owned businesses
  • Holders of a prospecting license, retention license, or a prospecting waiver


Additionally, the Company has to:

  • Established domicilium citandi et executandi in Botswana.
  • Incorporated under the Company Act and carries business of mining under the license.
  • Not been in liquidation or under judicial management, except where such liquidation or judicial management is part of a scheme for reconstruction or amalgamation of such company.
  • None of the Directors or Shareholders are disqualified as an individual under the above requirements of an individual.


FeesEdit

  • An annual lease rental fee is charged at BWP 100.00 per square kilometer, the first annual lease is paid on receiving the mining license and then paid annually on the anniversary of the license.


ValidityEdit

  • The license is valid for one year and renewable thereafter
