Procedure

Apply In-Person:

1. To apply for the division of land approach the Deputy Commissioner of your district.
2. Application on plain paper specifying mode of acquisition of land with a draft proposal for division.
3. Make sure that you have all the proper documents mentioned in the “Required documents” section below.
4. Submit the form to the Deputy Commissioner office along with the required documents. More details about the Deputy Commissioner office location is provided in the following link :Contact details
5. Refer the Deputy Commissioner Office location mentioned in the “Office location & contacts” section below.
6. The filled application form must be signed by all co-tenants.
7. Once, the application is submitted, notice is sent to the neighboring properties and local RI (Revenue Inspector) office in order to verify the neighboring plots and the land that you are applying for division.
8. Once it is verified, the local RI contacts you on your mobile number or on your postal address to confirm about your application.
9. Once it is confirmed, a surveyor is assigned from the local RI office.
10. The surveyor will be visiting and the division process is initiated.

Required Documents

The following documents must be attached with the application form to apply for division of land.

• Property documents.
• Sketch map proposing the division with plottable data, duly signed by all concerned.
• Attested copy of document of acquisition of rights (Deeds), if any.
• Draft proposal of sub-division in shape of map with adequate provision for utilities/road/path of at least 5 meters wide to be made. (in case the plots to be subdivided do not have independent access to the nearest road).
• Layout Plan indicating approach road etc.

Instructions

Provisions of this Act shall not apply to the following category of land:

• Land under GMC/M.B./T.C.
• Land owned by State Govt./Central Govt./Govt. Agencies/Corporations so long as the land is used for official purpose and not used or transferred for commercial purpose.
• Land owned by Local Authority and not used/transferred for commercial purpose.
• Land under tea cultivation.
• Land used for religious/charitable purpose.
• Land used for Aquaculture/Animal Husbandry including poultry/duckery.
• Land used for construction of dwelling house to the extent of 1 Bigha.
• Land within Industrial Zone.
• Land used for such other purposes as may be notified by the Government from time to time.
