ProcedureEdit

Apply Online

  1. To apply for the Bio-Diversity access permit, the applicant should make the application to National Environment Management Authority (NEMA) through their licensing portal via this hyperlink NEMA Licensing Portal.
  2. On the Licensing portal page, the applicant will be required to log in by entering his/her user name and password at the top right corner of the page.
  3. If the applicant does not have an account, the applicant should create one by clicking on the hyperlink “Click to Register(New Applicants Only)” at the top right corner of the page to be directed to the User registration page.
  4. On the user registration page, the applicant should enter his/her personal details, User name, and Password, Fill in the provided text, and then click on the “Submit” button and the system will automatically create the account.
  5. Upon creating the account, the applicant should click on the “Login” hyperlink and enter his/her user name and password then click on the “Login” button to go to his/her account.
  6. In the account, click on the “Bio-Diversity” hyperlink on the left panel of the page to go to the permit’s online application form.
  7. Complete the online form correctly filling all the mandatory fields.
  8. On completing the application, click on the “Submit” button and a message will be displayed saying the Form has been submitted successfully.
  9. Then the applicant should go to his/her email account and check-in Inbox or Junk to find the email from NEMA.
  10. The applicant should then click on the provided link and go to the payment page for the permit.
  11. On the payment page, the applicant should choose his/her preferred payment option and follow the given instructions to pay.
  12. Upon making the payment, an e-mail will subsequently be sent to confirm receipt of payment to the applicant’s email account, and also a Payment Receipt will be sent to the applicant via email.
  13. Print the payment receipt and keep it for future use.


Apply In-Person

  1. Upon applying online, the applicant will be required to submit ten hard copies of the application in person to the NEMA office, please view the NEMA contact details through this link Contact Detials
  2. Visit the NEMA office to obtain the application form for Access Permit in person or download the application form directly through this link ACCESS PERMIT APPLICATION FORM.
  3. Read and complete the application form correctly, note that part I of the application should be completed by Individual applicants and Part II by Applicants applying as corporates (organizations).
  4. Once the form is completed accordingly, gather all the required supporting documents and attach the documents to the application form in a single file, including the application payment receipt from the online application. Note that the application fee for individuals is Kshs. 20,000 and Corporate is Kshs. 50,000.
  5. Then visit the NEMA office and submit the application file to the receiving officer at the service desk.
  6. The officer will receive the application and issue the applicant with the acknowledgment receipt of the application.
  7. Then NEMA will issue a notice by publication in the Gazette or such other manner as it may consider appropriate, specifying the following:
    • The name and other particulars of the applicant.
    • The activity to be undertaken for which the access permit is required.
    • The time within which representations or objections in respect of the proposed access permit may be made to the Authority by the public.
  8. Then NEMA will consider the application for an access permit within 30 days from the date of the receipt of that application and the decision for consideration will be communicated to the applicant in writing.
  9. Once the application is considered by NEMA, NEMA will receive representations or objections to the proposed access permit from the public and review the application and if satisfied that the activity to be carried out will facilitate the sustainable management and utilization of genetic resources for the benefit of the people of Kenya, NEMA will approve the application and issue an access permit to the applicant within 60 days of applying and the permit will be valid for one year.
  10. If NEMA has reasonable grounds for refusing to issue an access permit to the applicant, NEMA will inform the applicant of the reasons for such refusal in writing and if the applicant is aggrieved by the refusal of the NEMA to grant the permit, the applicant may appeal to the Tribunal following its regulations.

  • The application fee for individuals is Kshs. 20,000 and Corporate is Kshs. 50,000.


Note that a convenience fee of Kshs. 50 will also be included.

InstructionsEdit

  • Every applicant issued with an access permit per the set-out regulations will strictly comply with the terms of that permit.
  • Where the purpose for which the permit was issued or the parties to the activity changes, the applicant is required to notify the authority and apply for approval to undertake the new activities or in a new manner as if it was a new application.
  • An access permit will contain such terms and conditions as the NEMA may consider necessary to impose.
