Apply In-Person

  1. To apply for Expungement, you should submit your application to the Ministry of Justice (MOJ). Please view the MOJ’s contact details via this link Link
  2. Obtain the application form from the MOJ office at the customer service desk or download the form directly through this link:Link
  3. Read the instructions provided and complete the application form in duplicate. Note that you should not photocopy the form.
  4. Then obtain two letters of recommendation from two certified referees who are not your family members and add two other persons who can be contacted on your behalf. The referees can be one of the following: Ministers of Religion, Justices of the Peace, Principals, Teachers, Attorneys-at-Law, Medical Practitioners and Police Officers of senior rank
  5. Then have your fingerprints taken and obtain the Fingerprints Impression at any of these locations: The Criminal Records Office located at 34 Duke Street, Kingston, Summit Police Station (St. James), May Pen Police Station (Clarendon), and Area 2 Police Headquarters, Pompano Bay (St. Mary).
  6. Go to any Inland Revenue Department (Tax Office) and pay the processing fee of the expungement application at the cashier and obtain the payment receipt
  7. Attach the required supporting documents including the payment receipt, Fingerprints Impression, and the recommendation letters to the two-application form in a single file and visit the MOJ’s office to submit the application at the service desk
  8. The official at the customer service desk will receive your application and verify ifit is completed as required and all the required documents are attached then you will be issued with the acknowledgment receipt of the application
  9. The MOJ will then request your police record from the criminal records office through the relevant MOJ authority
  10. After the receipt of the criminal record, the entire application will be forwarded to the Criminal Records (Rehabilitation of Offenders) Board by the MOJ for the board to assess the application and decide to approve or reject the application
  11. The MOJ will then notify you of the decision of the Rehabilitation of Offenders Board in writing through your contact details and if your application is successful and you have been expunged, you can apply for a clean police record at the Criminal Records Office.
  12. And if the application is rejected and you have been denied the expungement by the Criminal Records (Rehabilitation of Offenders) Board, you may re-apply to the Criminal Records (Rehabilitation of Offenders) Board after two years from the date of rejection. If the second application is also rejected, you may appeal the decision to the Minister of Justice within sixty days from the date of the second rejection.

EligibilityEdit

An individual who was convicted in Jamaica is eligible to apply, however, to qualify for expungement you must meet these two essential conditions:

  • The offense in question must attract a non-custodial sentence or sentence of imprisonment not exceeding five years
  • You must not have had any other convictions during a specified time known as the Rehabilitation Period.


Note that there are specified offenses under the schedule of the criminal records (rehabilitation of offenders) Act that are not eligible of being expunged

The processing fee for expungement is Three Thousand Dollars payable at the Inland Revenue Department (Tax Office).

InstructionsEdit

  • The two Letters of recommendation can be typed or handwritten (If handwritten, they should be legible) and MUST be dated, signed, have a return address, and include the following information:
  • How long the Referee has known you the applicant
  • How you the applicant conducts yourself
  • Whether the Referee would recommend that your conviction(s) be expunged
  • The two recommendation letters should be addressed to the Criminal Records (Rehabilitation of Offenders) Board, c/o Ministry of Justice, 61 Constant Spring, Kingston 10
