ProcedureEdit

  1. Complete a Business License Application Form, state the reason for the change of ownership application, along with these documents:
    1. A declaration stating that the nature of the business and / or its building have not changed, submitted using a Declaration Form.
    2. A photocopy of the current rental contract or property ownership title.
    3. Current versions of any documents that were missing in the file.
    4. Power of attorney for the business owner, if the application was submitted by someone other than the business owner.
    5. Business plans - in 5 copies.
  2. Make sure that you submit all required documents, the service agent will return the application if it is incomplete.
  3. Pay the application fee. The licensing fee can be paid at the Licensing Authority offices by credit card, or using a payment voucher at the post office or a bank.
  4. Your application will be reviewed by the licensing examiner. It will be then transferred for further review to the relevant intra-municipal and extra-municipal authorities:
    1. If the information in the business file matches the actual facts, the examiner will deliver the application to extra-municipal licensing authorities in order to receive their opinion.
    2. If the information in the business file does not match the actual facts, or if a change was made to the nature of the business and /or the building in which it operates, the licensing examiner will send the business owner a letter of rejection, stating that a new business license application must be submitted.
    3. Note: Receipt of a letter of rejection automatically cancels any temporary permit issued to the business owner.
  5. If a negative opinion (rejection letter) is received from one of the licensing authorities, the licensing examiner will send the letter to the business owner, in order to correct the deficiencies as soon as possible.
  6. If all licensing authorities approve the application, a business license will be issued by the licensing examiner. The business owner will automatically be sent a license, which will replace the temporary permit issued for the business.
  7. If one or more of the licensing authorities decides to grant a temporary permit (and no other licensing authority has denied the application), or if one or more of the additional authorities does not submit their evaluation within the time period required by law, and the application was denied by one of the authorities, a temporary permit will be issued for the business, whose period of validity will be set as the shortest period specified by one or more of the licensing authorities, as required by law.
  8. If one or more of the licensing authorities rejects the application, the business license application will be rejected.
  9. In the event that application was rejected the business owner has the option to appeal the rejecting authoritys decision by filing an appeal to the Court of Administrative Affairs within 60 days, or alternatively, by appealing the rejecting authoritys decision through the Business Licensing Authority, within 30 days of receiving the rejection letter.

EligibilityEdit

A business which has undergone a change in ownership (from a person, private or public company, association, nonprofit organization, institution, or any other entity which requires licensing), is required to submit a new business license application when the ownership or management of the business has been transferred to a person / entity other than the one specified in the license or business license application (addition / retirement of a partner, transfer of ownership to another party, change of company name, sale of rights to another company).
