Procedure

Apply By Mail:

1. To Request for Recognition as a Non-profit Religious, Charitable, Social Service, or Similar Organization, the applicant has to mail the application form to U.S. Department of Justice Link
2. The applicant can download the application form from the following link
3. The applicant has to fill in all the necessary details in the application form.
4. The applicant has to make sure to attach all the necessary documents that are mentioned in the “Required Documents” section of this page.
5. The applicant has to attach the photocopies of the required documents along with the application form while submitting.
6. Submit the completed form and the necessary documents to U.S. Department of Justice. The mailing address is given in “Office Location and Contacts” section of this page.
7. The Fee for this procedure is mentioned in Fees section of this page.
8. The concerned officer will examine the application for completeness and accuracy.
9. Once all the verification process is done by the authority, the applicant receives a receipt notice regarding the application.
10. The processing time for this procedure takes up to 30 days.

• Completed Form EOIR-31, including proof of service link
• Proof of non-profit status (IRS document)
• Copy of Charter, Constitution, By-Laws and/or Articles of Incorporation
• Fee schedule for all immigration services provided and membership dues, if applicable
• List of law library contents and/or online resources
• Funding sources and budget
• Organizational chart and a description of the specific immigration legal services the organization will provide
• Staff resumes, certificates of training, letters of recommendation and evidence of advocacy and research skills
• Requests for accreditation with supporting documentation, if applicable
• Written confirmation of any agreement(s) made to consult with other non-profit organization(s) or private attorney(s) on a pro bono basis in more complicated cases or other acceptable arrangements to demonstrate adequate knowledge and experience in immigration law and procedure.
• Copy of BIA decision on prior recognition application, if applicable.

Eligibility

• A non-profit religious, charitable, social service, or similar organization established in the United States and recognized as such by the Board may designate a representative or representatives to practice before the Service and the Board. Such organization must establish to the satisfaction of the Board that:
  
• It makes only nominal charges and assesses no excessive membership dues for persons given assistance; and
• It has at its disposal adequate knowledge, information and experience.
  

Fees

• The fee for this procedure has to be paid as per the authority request.
  

Validity

• Accreditation of representatives is valid for three years. Organizations must timely apply for renewal of their representative(s)’ accreditation. The schedule for renewal of recognition and accreditation does not run concurrently. Rather, it depends on when the expiration of each occurs.

Need for the Document

• The Department of Justice (DOJ), through the Executive Office for Immigration Review’s (EOIR) Recognition and Accreditation (R&A) Program, may authorize a non-profit religious, charitable, social service, or similar organization that provides immigration legal services primarily to low-income and indigent clients to provide representation through non-attorneys (“Accredited Representatives”) in immigration proceedings.

Others

• An organization recognized by the Board may apply for accreditation of persons of good moral character as its representatives.
• An organization may apply to have a representative accredited to practice before the Service alone or the Service and the Board (including practice before immigration judges).
• An application for accreditation shall fully set forth the nature and extent of the proposed representative's experience and knowledge of immigration and naturalization law and procedure and the category of accreditation sought.
• No individual may submit an application on his or her own behalf.
• An application shall be filed directly with the Board, along with proof of service of a copy of the application on the district director having jurisdiction over the area in which the requesting organization is located.
• The district director, within 30 days from the date of service, shall forward to the Board a recommendation for approval or disapproval of the application and the reasons therefor, or request a specified period of time in which to conduct an investigation or otherwise obtain relevant information regarding the applicant
