Procedure

Owners or operators of a vessel or vessels that have been issued a Bunker Certificate before will receive an email from Maritime Cook Islands containing instructions on how they can renew their Bunkers Certificate(s). In case you haven't received an email, please follow these steps:

1. Obtain a new blue card to from your P&I Insurer. This must be addressed to Maritime Cook Islands at P.O. Box 882 Avarua, Rarotonga, Cook Islands.
2. Get in touch with the Maritime Cook Islands through [email protected] and you will be given a link to a pre-filled online form containing information for your vessel(s).
3. Once you receive the new blue card(s), follow the link. Please check that the data MCI holds is correct and make any necessary amendments.
4. Click the “Proceed” button. You will be directed to an invoice page.
5. Do not forget to print a copy of the page for your records. You have the option to pay by credit card or by Telegraphic Transfer.
6. A confirmation email will be sent to your email address. Reply to that email with copies of your blue card(s) attached.
7. Once MCI receives confirmation of payment they will process your application and generate your certificate(s).

Eligibility

The Bunkers Convention applies to any ship having a Gross Tonnage greater than 1,000. It requires all registered owners of vessels entering or leaving a port or terminal in the territory of a Party to maintain insurance, certified by State Party to the Convention.

Fees

Cook Islands Bunker Certificate : USD $250 per ship

Payment can be made online by credit card or by telegraphic transfer.

Instructions

The Bunkers Convention established a strict liability on the part of the shipowner which held them accountable for any pollution damage arising from all types of oil used in the operation or propulsion of ships.

The Convention applies to any ship having a Gross Tonnage greater than 1,000. It requires all registered owners of vessels entering or leaving a port or terminal in the territory of a Party to maintain insurance, certified by State Party to the Convention.

The Convention introduces a provision that entitles claimants to claim directly from the owner’s insurer or enter into litigation proceedings against both the owner and/or insurer.

The Convention applies exclusively to pollution damage caused in the territory, including the territorial sea, and the exclusive economic zone (EEZ) of a State Party, and preventive measures, wherever taken, to prevent or minimize such damage.

Ships registered in a State which is not party to the Convention, must obtain State-issued certificate from a State Party to the Convention.

Cook Islands is a State Party and can issue Certificates to ships which are not registered under the Cook Islands Flag.

Information which might help

To all applicants: Completion of an Application Form and payment of the renewal fee does not guarantee that your application will be approved and a Certificate will be isued. Certificates will only be issued once the Cook Islands Administration is satisfied that the vessel is in compliance with the requirements of the Convention. No refunds will be given.

The 1996 LLMC Protocol establishes the limit of liability for ships according to gross tonnage (or in the case of passengers, a calculation based on the number of passengers the ship is licensed to carry). The limit of liability for property claims for ships not exceeding 2,000 gross tonnage is 1.51 million SDR (Special Drawing Rights) up from 1 million SDR. For larger ships, the following additional amounts are used in calculating the limitation amount:
a) For each ton from 2,001 to 30,000 tons, 604 SDR (up from 400 SDR)
b) For each ton from 30,001 to 70,000 tons, 453 SDR (up from 300 SDR)
c) For each ton in excess of 70,000 tons, 302 SDR (up from 200 SDR)
