Procedure

Following are steps on how you can apply for a Bunker Certificate:

1. Click the link to apply for a Bunker Certificate online - link.
2. Enter the all the required information:
   1. Full Name of Applicant
   2. Applicants Phone Number
   3. Address of the principal place of business of owner
   4. Preferred shipping method for Certificate(s)
   5. Name of Ship
   6. Name of Registered Owner
   7. IMO number
   8. Call Sign
   9. Gross Tonnage
   10. Flag State
   11. Port of Registry
   12. Approved P&I Club or Insurer - list
       If the P&I Club that your vessels is insured with is not on the list, contact MCI at [email protected] and advise them of the Clubs details.
3. After entering all the needed information proceed to the payment options. Application fee is USD $250.00 (per ship). An invoice will be generated for the total amount to be paid in USD. Print the invoice if required.
4. You have the option to pay by credit card (Visa or Mastercard only) or by telegraphic transfer. An email will be sent confirming approval of credit card payment or instructing procedure for telegraphic transfer payments. A duplicate copy of the invoice in PDF format will be attached.
5. Reply to the confirmation email, attaching the Blue Cards for all ships you are applying for. Maritime Cook Islands will check the Blue Card(s) you have submitted against the application form and check the P&I Club ship search facility to confirm validity. If everything matches, MCI will generate the certificate(s).
6. The Bunkers Certificate(s) will be sent to the address entered in the application by Courier.

Eligibility

The Bunkers Convention applies to any ship having a Gross Tonnage greater than 1,000. It requires all registered owners of vessels entering or leaving a port or terminal in the territory of a Party to maintain insurance, certified by State Party to the Convention.

Fees

Cook Islands Bunker Certificate : USD $250 per ship

Payment can be made online by credit card or by telegraphic transfer.

Instructions

The Bunkers Convention established a strict liability on the part of the shipowner which held them accountable for any pollution damage arising from all types of oil used in the operation or propulsion of ships.

The Convention applies to any ship having a Gross Tonnage greater than 1,000. It requires all registered owners of vessels entering or leaving a port or terminal in the territory of a Party to maintain insurance, certified by State Party to the Convention.

The Convention introduces a provision that entitles claimants to claim directly from the owner’s insurer or enter into litigation proceedings against both the owner and/or insurer.

The Convention applies exclusively to pollution damage caused in the territory, including the territorial sea, and the exclusive economic zone (EEZ) of a State Party, and preventive measures, wherever taken, to prevent or minimize such damage.

Ships registered in a State which is not party to the Convention, must obtain State-issued certificate from a State Party to the Convention.

Cook Islands is a State Party and can issue Certificates to ships which are not registered under the Cook Islands Flag.

Information which might help

To all applicants: Completion of an Application Form and payment of the Application Fee does not guarantee that your application will be approved and a Certificate will be isued. Certificates will only be issued once the Cook Islands Administration is satisfied that the vessel is in compliance with the requirements of the Convention. No refunds will be given.

The 1996 LLMC Protocol establishes the limit of liability for ships according to gross tonnage (or in the case of passengers, a calculation based on the number of passengers the ship is licensed to carry). The limit of liability for property claims for ships not exceeding 2,000 gross tonnage is 1.51 million SDR (Special Drawing Rights) up from 1 million SDR. For larger ships, the following additional amounts are used in calculating the limitation amount:
a) For each ton from 2,001 to 30,000 tons, 604 SDR (up from 400 SDR)
b) For each ton from 30,001 to 70,000 tons, 453 SDR (up from 300 SDR)
c) For each ton in excess of 70,000 tons, 302 SDR (up from 200 SDR)
