You must be outside the country of nationality/former habitual residence to lodge application for asylum in Australia.
- You must have a well-founded fear.
- You must be a victim of persecution.
- Your grounds for persecution are based on race, religion, nationality, membership of a particular social group, or political opinion.
- You must be unable or unwilling to seek that country's protection or to return there.
- If you do not meet the refugee definition, you may still be granted protection in Australia if you are found to meet the complementary protection criteria:
- You must have "substantial grounds for believing that, as a necessary and foreseeable consequence of being removed from Australia to [your] home country, there is a real risk that [you] will suffer significant harm."
- You must Pass character and security checks
- The applicant must go through required health examinations
- Application for a Protection Visa must be made with the Australian Department of Immigration and Citizenship (DIAC).
