ProcedureEdit

Apply In-Person:

  1. To Complaint about Judicial Misconduct or Disability, the applicant has to approach the United States Federal Court offices link
    NOTE: Search by address, city, state or ZIP Code and click the “Location” button.
  2. The applicant has to download the application form from the following link
  3. The complaint must be legible, and preferably typed
  4. The applicant has to fill complaint in legible, and preferably typewritten in the application form. (Incomplete applications are not accepted)
  5. Make sure that the applicant has to attach all the necessary documents that are mentioned in the “Required Documents” section of this page.
  6. The applicant has to attach the photocopies of the required documents along with the application form while submitting.
  7. Submit the completed the form along with the necessary documents to the U.S court office.
  8. If the complaint is against the federal circuit judge, federal district judge, federal bankruptcy judge, or federal magistrate judge, the applicant must file the complaint at the clerk’s office of the United States court of appeals for the regional circuit in which the judge serves.
  9. If the applicant is complaining against a judge of the United States Court of Appeals for the Federal Circuit, the applicant must file the complaint at the circuit executive’s office of that court.
  10. The clerk and circuit office will provide the copy of the complaint to the United State Court office and to the complaining judge.
  11. The fee for this procedure has to be paid as per the authority’s request.
  12. After receiving the application, the concerned authority will check the submitted application and document set. If all are in place, the application will be accepted.
  13. Once the verification process gets completed, the applicant gets call from the court office.
  14. The applicant has to visit the office for further process.
  15. This entire process can be completed in 30 days or as per the timeline advised by the respective department authority.

  • Do not mention the complaining judge's details on the envelope.
  • All circuit court office details in mentioned in the “Information which might help” section of this page.

Examples of judicial misconduct may include the following:

  • Using the judge’s office to obtain special treatment for friends or relatives.
  • Accepting bribes, gifts, or other personal favours related to the judicial office.
  • Engaging in improper ex parte communications with parties or counsel for one side in a case
  • Engaging in partisan political activity or making inappropriately partisan statements.
  • Soliciting funds for organizations.
  • Violating rules or standards pertaining to restrictions on outside income or knowingly violating requirements for financial disclosure.
  • Engaging in unwanted, offensive, or abusive sexual conduct, including sexual harassment or assault.
  • Treating litigants, attorneys, judicial employees, or others in a demonstrably egregious and hostile manner.
  • Creating a hostile work environment for judicial employees.
  • Intentional discrimination on the basis of race, colour, sex, gender, gender entity, pregnancy, sexual orientation, religion, national origin, age, or disability.
  • Retaliating against complainants, witnesses, judicial employees, or others for participating in the judicial conduct and disability complaint process, or for reporting or disclosing judicial misconduct or disability.
  • Refusing, without good cause shown, to cooperate in the investigation of a judicial conduct or disability complaint or enforcement of a decision under the rules; and
  • Failing to call to the attention of the relevant district chief judge or circuit chief judge any reliable information reasonably likely to constitute judicial misconduct or disability.
