ProcedureEdit

  1. Land acquisition involves, Acquiring body, the processing body and the land owner.
  2. Acquiring body will process the requirement based on the government provision.
  3. Collectorate is responsible for the requisition for acquisition of land for public purpose related to different projects of development is concerned. Assessment of valuation of land on requisition is also governed by the department.<br.

Apply In-Person

  1. Applicant has to approach the respective collector office (Collector of concerned District) to make request.

  3. An application form can be obtained from respective office on your visit or can be a written one.
  4. Applicant should complete the form and enclose the required documents and submit to the collector for that district (in few cases, application has to be made to the “Directorate of Administrative Reforms”).
  5. Along with the application, please make sure you have the entire following listed document.
    • Copy of Land Documents
    • Copy of recent Encumbrance Certificate
    • Present Patta
  6. Once the application is accepted Collector shall constitute a team of revenue and agriculture Officers (if applicable) of the district. They will visit the spot mentioned and make enquiry whether the requisition is consistent with the provisions.
  7. They make field visit with the requiring body to examine the revenue records of the proposed land, meet the families likely to be affected and submit a report based on the above process to the Collector regarding the requisition being consistent or contrary to the provisions.
  8. Collector will issue respective orders based on the report.
  9. The appropriate authorities will work with the process of acquisition of land.

Note: After collector receives the report, if any enquiries required then that will be carried out as per their mode.

Land Acquisition Act empowers Government Acquisition of private land for public purpose or for assignment to land less poor for house sites. RDO is the land acquisition officer. Requisition for the land has to be received from the requisitioning authority. The first stage in the land acquisition process is Draft Notification. Joint inspection of LAO and requisitioning authority has to be conducted. During the Draft Notification stage proposal are sent to the Collector along with various documents such as Draft Notification, joint inspection note, extract of Fair Adangal for the lands, extract of Village Account no. 3 etc.

In cases of urgency the provisions under section 17 of the act have to be invoked. If urgency clause is invoked possession of land will be taken within 90 days. Draft declaration has to be published without conducting enquiry.

Draft Notification should be published in the state official Gazette and at least in two Daily News Papers.

The Draft Declaration should be published within a year from the date of Draft Notification.

Objections of persons interested are heard and disposed off (Section 5 - A enquiry).

Draft Declaration proposals consists of Draft Declaration statement showing variation between Draft Notification and Draft Declaration with reasons, Section 5 - A enquiry record etc.

Then preliminary valuation proposals are sent along with required documents. An award should be passed within two years from the date of publication of declaration. On the date of award enquiry the claims of the landowners regarding their title and their interest over the lands and the amount of compensation they claim have to be considered. Based on certain factors the compensation payable to the landowner is arrived at. After tendering payment of compensation the position of land can be taken in case of urgency. In certain cases LAO can take the possession of the land even though no award has been made

Need for the DocumentEdit

  • The Land Acquisition Act, 1894 is a law in India that allows the government to acquire private land in that country.
  • In view of urbanization, Industrialization or development of infrastructural facilities the Union or a state government acquires private land and provides compensation to the affected land owners and their rehabilitation / resettlement.
  • Land Acquisition Collector or the respective authority, is the land acquisition officer. Requisition for the land has to be received from the requisitioning authority.
