Procedure

Apply Online

1. To Register an Art Gallery, the applicant has to make the application online via the following link link
2. The applicant must click “Sign In” and enter username and password to Logging in. if the applicant is a new user the applicant must click “Sign up” and follow the steps to register an account.

Step 1: Obtain a Digital Signature Certificate (DSC) The first step is to obtain a Digital Signature Certificate (DSC) from all the directors. Documents required to obtain a DSC are:

1. PAN Card of the Director
2. Aadhaar Card of the Director
3. Photo
4. Email Id
5. Contact Number

Step 2: Obtain the Director Identification Number (DIN)

1. After obtaining the DSC, the next step is to obtain the Director Identification Number (DIN) by filing form DIR – 3 or SPICe+ Form along with a self-attested Identity proof, address proof, and a photo.
2. make the payment of filing fee of e-Form DIR-3. Only electronic payment of the fees shall be allowed (i.e., Net banking / Credit Card/Debit Card/Pay later/ NEFT).
3. The user is required to get himself / herself registered on the MCA21 Portal to obtain Login ID. Login to the MCA21 portal and click on 'e-Form upload' link available under the 'e-Forms' tab for uploading the e-Form DIR- 3. E-Form DIR-3 will be processed only after the DIN application fee is paid.
4. Upon upload and successful payment, in case Form DIR-3 details have not been identified as potential duplicate, Approved DIN shall be generated and if the details have been identified as potential duplicate, Provisional DIN shall be generated.

Step 3: Name Approval & Registration

1. Then the name of the Art Gallery is to be finalized. For that, Form SPICe+ to the Registrar of Companies (ROC) is to be filed by giving 2 names in the order of preference along with the significance of the names. The name shall have the words ART GALLERY at the end.
2. After the name is approved by the ROC, the following documents are to be prepared
3. The Memorandum of Association is to be drafted by incorporating all the objects that the company intends to follow.
4. The Articles of Association is to be drafted containing all the by-laws of the company.
5. An affidavit has to be signed by all the subscribers of the proposed company declaring their legal competency to act as the subscribers.
6. A utility bill and a NOC have to be taken from the owner whose address is to be used as the registered office of the company. If it is not owned, a lease agreement will be attached to the form.
7. All the drafted documents will be attached to Form SPICe+ and uploaded to the ROC website. On proper verification, the ROC will issue a Certificate of Incorporation and the company can start its business operations.
8. This form of establishment promotes the primary producer who is in a low-income group to optimize their income with collective bargaining and by selling the products directly to consumers.
9. This entire process can be completed in one month or as per the timeline advised by the respective department authority.

Step 4: Registration with local authorities:

1. Depending on the location and size of your gallery, you might need trade licenses or permits from local municipal authorities, especially if you plan to host events or exhibitions.
