This procedure explains various ways to Register Industrial Design in Zamboanga City.

Apply In-Person

Here's how you can register an industrial design with the Intellectual Property Office of the Zamboanga City in person. But, before you start your application, you will need to do a quick search using IPOPHL's database first and read documents about currently registered industrial designs, industrial design applications, and pending industrial design application. Try to look for industrial designs that bears similarity with the one you are applying for. If you can, do a little bit of research. Next, you will need to fill out three (3) copies of the Industrial Design - Registration Form (link to download the form can be found under 'Documents to Use' section).
Attach the following documents to your application:
1. Specification and description of the industrial design:
  - The Title
  - Brief explanation of the drawings
  - Characteristic features (if any)
  - An omnibus claim for industrial design: “I claim the new and ornamental design for a ______ substantially as shown and described.”
2. Drawings of the industrial design (combine all drawings into one PDF file)
Submit all the required documents and pay the application fee at the IPOPHL cashier.
Your application will be examined by IPOPHL. The Office will also publish your industrial design application for 30 days.
Once approved, a Certificate of Registration will be issued to you. Also, the IPOPHL will publish the newly registered industrial design.

EligibilityEdit

An industrial design may be registered if it is NEW or ORIGINAL creation:

The following industrial designs may not be registered:

(a) Industrial designs that are dictated essentially by technical or functional considerations to obtain a technical result;
(b) Industrial designs which are mere schemes of surface ornamentations existing separately from the industrial product or handicraft; and
(c) Industrial designs which are contrary to public order, health, or morals.

Who can file the application: The industrial design application can be filed by any individual or juridical entity. For applicants who are non-residents of the Philippines, you will need to hire a resident agent or an authorized representative in the Philippines who will thereafter prosecute the application in behalf of you or your company. A copy of the Special Power of Attorney or Appointment of Resident Agent should be submitted as soon as possible.

Pre-Examination:
- Filing fee: 1,720.00
- For each sheet in excess of 30 claims UM: 18.00
- Sequence listings for UM in excess of 4000 pages (Note 1): 0 .60
- For each claim in excess of five (5) - UM: 120.00
- For each embodiment in excess of one (1) Industrial Design: 860.00
- Request for right of priority (per priority claim): 860.00
- Divisional application (for each division): 1,720.00
- Conversion from Invention to Utility Model: 330.00
Examination:

Note:

Section 10. Legal Research Fund (LRF) - All fees and charges, except charges for domestic photocopy and sequence listings for invention patent applications in excess of 4,000 pages, shall be subject to the payment of the LRF required byRepublic Act 3870 as amended by Presidential Decrees Nos. 200 and 1856, at the rate of one percent (1 %) of the fee paid but not less than Ten Pesos (Php10.00). In this regard, the IPOPHL shall furnish the University of the Philippines Law Center reports on its collection and remittance of the LRF.

ValidityEdit

Registration of an industrial design is valid for a period of 5 years from the filing date of the application. Registration may be renewed for not more than two (2) consecutive periods of five (5) years each by paying a renewal fee. The fee must be paid within a year of the expiration of the registration.

Provisions applied to patents are also followed for industrial designs.

Having your industrial design properly registered with the Intellectual Property Office of the Zamboanga City gives you the right to prevent third parties from making, selling or importing articles bearing or embodying a design which is a copy, or substantially a copy, of your design, when such acts are undertaken for commercial purposes.
