ProcedureEdit

Apply In-Person:

  1. To apply for Responding to Land Invasion in person, the applicant has to visit the nearest court in his or her province.
  2. The contact details and address information of the office of the Department of Justice and Constitutional Development ion South Africa can be found in the following link: Link
  3. Contact the office of DoJ&CD and enquire about how and where to apply for an eviction order in response of a Land Invasion.
  4. Visit the office of court as instructed by the office of DoJ&CD and obtain an application form to apply for an Eviction order from the relevant department.
  5. Else, use the link to download the application form: Link
  6. Fill the form as applicable to your requirement and relevant information. Once you have completed the form, make sure that you have attached the required documents as instructed with the completed form.
  7. After submission, the application form and attached documents will be verified and validated correspondingly by the concerned officials.
  8. Once all the necessary processes got over, the application will be approved and applicable assistance will be provided to the applicant.

  • Any person, who is a private landowner and his/her land is under invasion by some occupants, can apply for an Eviction order.
  • The person applying must be registered properly as owner of the land concerned and he/she must possess the Document of Registration at the time of application.

Need for the DocumentEdit

Where unlawful occupiers whose basic rights are not at risk have to be evicted, the private land owner must, without delay, approach the court for an eviction order in terms of the Prevention of Illegal Eviction From and Unlawful Occupation of Land Act, 1998 (Act 19 of 1998).

  • Both state land (land under the control of a national or provincial government or municipality) and privately-owned land can be invaded unlawfully.
  • Government has a constitutional duty to ensure – where required and with available resources – that all citizens can enjoy their basic rights to access to land and to housing. Where large-scale invasions occur, government has a similar duty to assist private landowners to protect their land.
