ProcedureEdit

Apply In-Person:

  1. To Obtain Road Accident Fund, the applicant must go to the Transport Department office in South Africa. Contact Link
  2. The application form must be obtained from the authorities at the Transport Department. Application Form Link and Application Form Link
  3. Make sure that you have all the documents that are mentioned in the “Required Documents” section of this page.
  4. The application form must be filled with necessary details, and along with the required documents should be submitted to the respective officials at the Transport department.
  5. The application will be forwarded to the Road Accident Fund Commission Board.
  6. The officials at the Commission will verify the accident legitimacy, the persons involved, and so many more factors.
  7. Also, the commission may or may not investigate any number of people in regards to the Road Accident Fund.
  8. After the complete verification process, if the accident is genuine and covers the eligibility criteria set the Transport department, then the Road Accident Fund will be approved to the applicant.
  9. No fee is required to file the Road Accident Fund application to the RAF Department.
  10. The process to get approval for the Road Accident Fund will take an approximate time of up to 1 year.

Required DocumentsEdit


Standard documentation applicable to both death and injury benefits:

  • Certified Copies of Identity Documents.
  • Accident Report Form, Case docket and sketch plan.
  • Power of Attorney and Contingency Fee Agreement.
  • Permission for the Fund to obtain and inspect hospital and medical records.
  • All statements and documents in claimant’s possession.
  • When the claimant is claiming in the capacity as guardian of a minor or for loss of support, copies of the unabridged birth certificate must accompany the claim form.
  • If it is a Curator submitting a claim, certified copy of Court order/Masters’ letters of appointment.


Claims administration requirements for death benefits claims:
Funeral Claim

  • Death certificate
  • Proof of the relationship of claimant to deceased (certified marriage certificate/ unabridged birth certificate/Affidavit confirming relationship)
  • Post - mortem report
  • A tax invoice for funeral expenses with proof of payment


Loss of support

  • Certified copy of deceased’s ID
  • Certified copy of death certificate
  • Curatorship: Certified copy of court order/Letters of appointment
  • Certified copy of marriage certificate/certificate proving customary marriage/un-abridged birth certificate
  • If not married, an affidavit setting out the legal basis of claimant’s dependency on deceased.
  • Deceased’s medical and hospital records, if applicable [2.2.2.7 Link] Specified vouchers for medical costs if claimed.
  • Post-mortem report/ Inquest record/charge sheet/other documents proving that the deceased was killed in the accident.
  • Employer’s certificate of deceased’s service showing nature of employment, the period of service, remuneration, prospects of advancement and compensation and retirement age.
  • Deceased’s Payslips
  • Deceased’s tax records (if not available, communication from SARS that Claimant is not registered for tax) in which case a bank statements for three years preceding death will be required.
  • Proof of any additional income (if applicable)
  • Copy of Liquidation and Distribution account.
  • Copy of maintenance order (if applicable)
  • The child support grant official documents (if applicable)
  • Employer’s certificate of spouse indicating the period of employment, remuneration and advancement prospects.
  • Official confirmation of the Compensation Fund’s award if deceased died during the course and scope of employment.
  • Actuarial report


Claims administration requirements for injury benefits claims

  • Past Medical Expenses
  • An itemised tax invoice from a registered medical provider or hospital for past medical expenses, together with proof of payment.
  • Loss of earnings.
  • Copies of all medical and hospital records, including photographs of the injuries
  • Employer’s certificate showing nature of employment, the period of employment, remuneration, prospects of advancement and retirement age.
  • Proof of any other income, if applicable.
  • Claimant’s tax records (if not available, communication from SARS that Claimant is not registered for tax) in which case a bank statements for three years preceding death will be required.
  • Payslips pre and post-accident
  • Copies of all hospital and medical records
  • Copies of all hospital and medical accounts
  • Medical reports or documentation establishing or substantiating claimant’s temporary/permanent disability and the loss of earnings claimed
  • Official confirmation of remuneration/compensation received from other sources
  • Official documentation confirming any disability grant
  • Official confirmation of the Compensation Fund’s award if claimant was injured during the course and scope of employment.


General damages

  • Duly completed RAF 4 FORM
  • Copies of all hospital and medical records
  • Medical reports
  • Photographs of injuries or scarring, where applicable


Mandatory information / documentation to be submitted for claims payments

  • To ensure that payments are processed in line with the settlement agreements concluded and/ in compliance with court orders, the following documents must accompany any request for payment
  • Stamped Court Order/duly signed discharge form or settlement agreement
  • Duly signed Power of Attorney
  • Tax clearance certificate, which shall be submitted by the claimants’ attorneys at least once a year.
  • Proof of banking details / confirmation of Banking Details (Trust Account).
  • Copy of the Contingency Fee Agreement concluded with the claimant and Proof of compliance with section 4 of the Contingency Fee Act, alternatively, the attorney must submit an affidavit to confirm that there is no contingency fee agreement.

EligibilityEdit

The eligibility criteria to claim the road accident fund includes:

  • A person who was personally injured (except a driver whose negligence was the sole cause of the accident) including a claimant under the age of 18 years, provided he is assisted by a parent or legal guardian.
  • A dependant of a deceased victim.
  • A representative of the estate of a deceased or a close relation in respect of funeral expenses.

  • No fee is required to file the Road Accident Fund application to the RAF Department.



ValidityEdit

  • The Road Accident Fund Claim must be lodged by the claimant within three years from the date of the accident or from the date on which the claim arose.
