Procedure

Apply In-Person:

1. To Apply for Transfer of Radio Frequency Spectrum Licences, Certificates and Authorities, the applicant must go to the Independent Communications Authority of South Africa’s (ICASA) office. Contact Link
2. The application forms “Application to Transfer a Radio Frequency Spectrum Licence Form C” must be obtained from the authorities at the ICASA office, else the application form can be downloaded from the official website linked here. Application Form Link
3. Make sure that you have all the documents that are mentioned in the “Required Documents” section of this page.
4. The application form must be filled with all the necessary details, and along with the required documents, it must be submitted to the respective officer in the ICASA department.
5. The authorities will verify the application and the documents submitted by the applicant.
6. After verification, if all the details are legitimate then the Spectrum License will be transferred in the name of the Transferee mentioned in the application form.
7. The fee and the processing to transfer the spectrum license will be mentioned to the applicant at the time of filing the application at the ICASA.

Eligibility

• Any individual holding the license of the “Radio Frequency Spectrum License” is eligible to apply for the Transfer application of Spectrum License.

Fees

• The fee to transfer the spectrum license will be mentioned to the applicant at the time of filing the application at the ICASA.

Validity

• The validity period of the Transferred License will be mentioned in the License certificate issued to the Transferee.

OWNERSHIP AND MANAGEMENT OF APPLICANT

• Provide details of all ownership interests in the applicant and the identity and address of each holder of an ownership interest in the applicant. Where an applicant is a juristic person, only shareholdings (or equivalent) of 5% or more of the total issued shares (or equivalent) in the applicant are relevant.
• Indicate whether the applicant is listed on any stock exchange, and provide details of any such listing

• Indicate the extent to which any ownership interest referred to above is held by an historically disadvantaged person

OWNERSHIP AND BUSINESS PLAN

• Indicate details of ownership and control by historically disadvantaged persons
• Provide details of the transferee’s business plan in respect of the licensed service outlining details
• Provide details of how the following will be achieved by the licensee
  • Technical efficiency
  • Functional efficiency
  • Economic efficiency
• Provide separately and mark clearly as ANNEXURE A of FORM C 6, copies of the transferee’s audited annual financial statements for the previous three years

APPLICANT’S LICENCE OBLIGATIONS

• Indicate those obligations of the applicant in terms of the Licence which have been discharged and those which will assumed by the transferee, should this application be granted
• Provide separately and mark clearly as ANNEXURE A of FORM C 7, a written undertaking given by the transferee, through its duly authorised representative, that it will comply with the applicant’s Licence obligations in the event of the transfer application being approved by the Authority
• Provide reasons for the transfer of the Radio Frequency Spectrum Licence
