Apply In-Person:
- To apply for Protecting arrested children in person, the applicant has to visit the nearest children’s court or office of Department of Justice and Constitutional Development in his/her province.
- The contact and address details can be found in the following link: Link
- Visit the court or office of DOJ & CD and obtain an application form to apply for Protecting arrested children (if any) from the clerk or concerned official at the premises.
- Make sure you have attached all the documents listed in the ”Required Documents” section of this page.
- Then, complete the application form and submit it along with all required documents to the concerned official or clerk of the court.
- After submission, the application form and attached documents will be verified and validated correspondingly by the concerned officials.
- When the officials find the application and documents in order, further proceedings will take place according to the Child Justice Act.

- The child who is accused to have committed the crime must be below 18 years of age.
- Any child who is accused to have committed a crime and in need of special care or protection, is eligible to apply for protection.

- In terms of the Child Justice Act an informal process called a preliminary inquiry will be held within 48 hours of the child’s arrest, before the first court appearance.
- The preliminary inquiry will be attended by different people, such as a Magistrate, the child, his/her parents, a Prosecutor, a Probation Officer, the arresting police officer, and a Legal Aid Attorney.
- If the child is in need of care or protection, the matter will be referred to the children’s court which will determine suitable interventions.
