- To Obtain the Transfer of Rights of the Concession Title to Build and Use Terminals, Marinas and Port Facilities, the applicant has to approach the Secretariat of Infrastructure, Communications and Transportation link
- An application form will be provided to the applicant by the concerned officer.
- The applicant has to fill in all the necessary details in the application form. (Incomplete applications are not accepted)
- Make sure that the applicant has attached all the necessary documents that are mentioned in the “Required Documents” section of this page.
- The applicant has to attach photocopies of the required documents along with the application form while submitting it.
- Submit all the documents with the completed form to the concerned officer.
- The applicant has to pay the prescribed fee as requested by the authority.
- After receiving the application, the concerned authority will check the submitted application and document set. If all are in place, the application will be accepted.
- Then the application will be processed further.
- The authority will evaluate the transfer request based on compliance with legal requirements, financial capacity, and the suitability of the new concessionaire. They may also assess the impact of the transfer on the port's operations and the public interest.
- If the transfer is approved, negotiate with the regulatory authority and the existing concessionaire to amend the original concession agreement. This amendment will reflect the transfer of rights and update the parties involved in the concession.
- Once the transfer of rights is completed, the new concessionaire assumes the responsibilities and obligations outlined in the amended concession agreement.
- It is essential to fulfill all obligations, including financial commitments, operational requirements, safety regulations, and environmental obligations.
- This entire process can be completed within 2 weeks or as per the timeline advised by the respective department authority.
