ProcedureEdit

Residence permits for a specified period of time are issued to foreigners on the basis of an administrative decision of the provincial governor of Ma?opolska made on the basis of an application.

Required DocumentsEdit

Application for residence permit for a fixed period (download)

  • copies of the application for the permit to settle filled out in compliance with the instruction.
  • 4 up-to-date, colour photographs, dimensions: 4.5 cm x 3.5 cm.
  • Valid travel document (3 photocopies).
  • Documents confirming the required uninterrupted stay in Poland.
  • Certificate about the fulfilment of tax liabilities towards the State Treasury.
  • Current confirmation of registration for temporary residence.
  • Legal title to occupy the apartment in which the applicant stays or intends to stay.

Additional required documents:

In case of marriage to a Polish citizen:

  • Current copy of marriage certificate
  • Photocopy of the personal identity card of the spouse
  • In case of joint children copies of birth certificates

In case of the minor being a foreigners child who has a permit to settle and was born in the territory of the Republic of Poland:

  • Copy of birth certificate
  • Copy of the decision on granting permit to settle or residence card of the statutory representative

In case of the child of Polish citizen being under his/her parental authority:

  • Copy of birth certificate
  • Copy of personal identity card of the statutory representative.

EligibilityEdit

Residence permit for a fixed period can be granted to a foreigner who stays in the Republic of Poland illegally, if:

  • regulations of Polish law require personal appearance of a foreigner before a Polish public authority;
  • exceptional personal situation of a foreigner requires his/her presence in the Republic of Poland;
  • it is required by the interest of the Republic of Poland;
  • an authority competent for conducting proceedings concerning trafficking in human beings states that the foreigner is probably a victim of trafficking in human beings within the meaning of the Council Framework Decision of 19 July 2002 on combating trafficking in human beings (OJEC L 203 of 01.08.2002 page 1, special Polish publication of OJ, Chapter 19, Vol. 6 page 52).

Stamp duty for issuing a permit (payable at the time of submitting an application): PLN 340. The payment can be made in cash:

  • in the Administrative Center of the City of Cracow, Al. Powstania Warszawskiego 10, Krakow, on the ground floor or first floor (entrance from ul. Kordylewskiego);
  • in the banking agency in the Department of Nationals' and Foreigners' Affairs, Krakow, ul. Przy Rondzie 6
  • or in a bank or a post office to the following bank account:

ValidityEdit

Residence permit for a fixed period is granted each time for a period necessary for realization of the purpose of stay in the Republic of Poland not longer, however, than 2 years.

Processing TimeEdit

Residence permits for a fixed period are issued to foreigners within 1 month from the date of submitting a required application form together with documents. In particularly justified situations not later than within 2 months from the date when the procedure begins.

InstructionsEdit

A foreigner is obliged to collect the residence card in person or, if a foreigner is a minor below 13 years of age, the card must be collected by the minor's legal representative or a legal guardian.



Required InformationEdit

Information needed to complete the form: date and place of birth, marital status, education, citizenship, place of residence, the period for which the alien wants to obtain the residence certification, and data from the passport (or other document confirming identity) and social security number PESEL (those who do not have it, are automatically assigned a PESEL number at the district bureau during the residence certification procedure).



Need for the DocumentEdit

A residence certificate is the document confirming foreigner's identity during his/her stay in the Republic of Poland and allowing the foreigner (when used together with a travel document) to repeatedly cross the border without the necessity to obtain a visa.


Information which might helpEdit

If the deadline for submission of the application was observed and the application does not contain any formal defects or they were completed on time, the voivode shall put a stamp imprint in the foreigners travel document, which confirms submission of the application. A foreigners stay in this period is considered legal until a final decision in the matter is issued. If proceedings on granting a residence permit for a fixed period of time are suspended at the request of the foreigner, their stay at that time shall not be considered legal.


Other uses of the Document/CertificateEdit

The proper certificate of residency issued for the natural person is a document in which the foreign tax administration authority confirms the tax residency of a given natural person, which is in the possession of the residential place by this person for the taxation purposes on the territory of a given country. It is equivalent to the treatment of such a person in this country as a person subject to the absolute tax obligation.
