ProcedureEdit

Apply In Person:

  1. To File Notice of Suspension or Removal from Professional Practice of an Insolvency Practitioner in person, the applicant should contact the Corporate and business registration department in Mauritius Contact link
  2. Applicants should download the application form from this link
  3. The application form should be fully completed and signed by the insolvency practitioner before submission.
  4. Applicants must ensure that they attach all the necessary documents such as a The Insolvency Practitioner’s CV, Certified copies of relevant professional qualifications, Certified copy of the Insolvency Practitioner’s valid practicing certificate, Certified copy of the Insolvency Practitioner’s professional indemnity insurance and they can be found under the “Required Document” section of this page.
  5. Applicants should Submit the completed application form to the Corporate and Business Registration Department in Mauritius, along with the required documents, to be considered for the desired opportunity.
  6. The Applicant may be required to appear before the Authorities to provide further information and/or answer queries related to the application to ensure that all necessary paperwork is completed accurately and that all relevant regulations have been adhered to.
  7. Upon submission of the application form, the applicant should also pay the required fee for the registration to receive a confirmation letter from the Corporate and Business Registration Department, as per the authority’s request.
  8. Once the fee has been paid, The Corporate and Business Registration Department will review the application and if an order is made, a Notice of Suspension or Removal from Professional Practice will be issued to the Insolvency Practitioner and all relevant parties.
  9. Within ten (10) days of the issuance of the Notice of Suspension or Removal from Professional Practice, the Insolvency Practitioner must comply with the terms of the Notice and must decide to transfer all their cases to another practitioner or close the cases.
  10. The Insolvency Practitioner must also decide to return all documents, books and records to their clients.
  11. Once the Compliance Order has been fulfilled, the Corporate and Business Registration Department will issue a Certificate of Suspension or Removal from Professional Practice of an Insolvency Practitioner.
  12. Then the Notice of Suspension or Removal from Professional Practice will be published in the Official Gazette and the Notice will also be available in the Corporate and Business Registration Department.
  13. Generally, the processing time can vary from a few days to several weeks.

  • Any person who is aggrieved by the conduct of an insolvency practitioner in Mauritius can file a Notice of Suspension or Removal from Professional Practice. This includes creditors, debtors, shareholders, directors, liquidators, administrators, receivers, and other stakeholders who have been adversely affected by the insolvency practitioner's conduct.
