ProcedureEdit

The Pest control product Board is responsible for the registration and renewal of each and every pesticide product sold and/or distributed in Kenya.The assessment of risks is important because it provides the basis for governments' decisions whether to approve, or "register," new chemical pesticides and whether to renew the registration of old ones.

Renewal of Pesticides Registration in Kenya include the following.

Step 1 Go to the Pesticide control Product board offices and present an application for renewing the registration certificate after the pesticide concerned passes the latest efficacy test (re-evaluation) (the Pest Control Products Act, Cap 346, Laws of Kenya of 1982 .)Fill in and submit the application form along with all other requirements.

Step 2. Documentation: Attach the following documents on the application form

a)The expiring Registration certificate .
b)Toxicological data prepared by pesticide central Laboratory committee.
c)Copies of all environmental impact studies.
d)Field and laboratory evaluation results and recommendations.
e)The original Registration Certificate to be renewed.
f)The original analysis certificate issued by the Pesticides Central Laboratory.
g)The original recommendation document for the pesticide.
h)The local study of the Pre-harvest Interval issued by the Pesticides Central Laboratory.

Step 3.Upon review, the Pesticides Committee(PC)refers the renewal application to the committee Technical Secretariat for further recommendation for approval/denial.

Step 4.If the committee accepts the renewal of pesticide registration, the applicant is required to Pay the renewal fees. The applicant is required to pay a renewal fees of at least KSh.20,000 or any other sum as may be prescribed by the Board from time to time and provide evidence of a performance.

Step 5.Before granting any Renewal of pesticide Registration, the Board in respect of an application before it shall satisfy itself:

a)that the applicant is a company incorporated under the Companies Act, with such minimum share capital as the Board may prescribe; and
(b)that the applicant has the necessary management capacity to carry on Pesticide business for which the Registration is required; and
(c)that the applicant has sufficient knowledge, experience and capacity to continue conduct Pesticide business or that the persons to be engaged in the position of Pesticide Officer or other senior position possess sufficient knowledge, management experience and capacity.

Step 6.When considering an application for renewal of a pesticide Registration, the Board shall require the applicant to submit the annual audited financial statements for inspection.

Then Registration Certificate is issued according to the regulations of form (5) attached to the the Pest Control Products Act, Cap 346, Laws of Kenya of 1982. if it is not renewed then it is canceled after the expiry of the time made available for the renewal of the pesticide registration.


step 7.The Registration Certificate is issued in three copies;

i)one given to the applicant,
ii)one kept in the Committee Secretariat and
iii)the third sent to the Pesticide Central Laboratory (the Pest Control Products Act, Cap 346, Laws of Kenya of 1982).

The new registration certificate expires after 3 years from the date of issuing, according to the Pest Control Products Act, Cap 346, Laws of Kenya of 1982.

To register or renew products is mandatory by Kenya Law.

i)Alternate product names (those products
ii)Which have the same formulation,
iii)Same manufacturer,
iv)Contain the same labeling claims and bear designations identifying the products as the same pesticide) must be registered separately on an annual basis, however, there is no additional registration fee.
v)Those pesticides which are undergoing field evaluation studies in Kenya and which are not sold to researchers cooperating in these field studies are exempt from the annual product registration fees.
vi)Each brand (brand line) of a pesticide must be registered separately
vii)Indicate the products toxicity from a single dose on every renewal.
viii)All pesticide labels must have a section to let you know how to properly store and dispose of the product.

Need for the DocumentEdit

Drug manufacturers, chemical manufacturers, growers, and food processors owe consumers a particular duty of care to produce food and other consumer products that are safe and will not cause public health concerns.

They also need to take part in safe practices for the growing of products so that environmental concerns, such as contamination, do not develop. Because of this they are required by law to Renew their pesticides every year.

Pesticide control product board regulations is the Kenyan Board responsible for renewal approval, monitoring and control of Pesticides. When these large companies are reckless in nature and do not take all necessary safety precautions when producing their products, they have committed a form of negligence. This type of negligence should not occur, and when it does, legal action needs to be taken to hold those responsible accountable for their actions. The action also includes denial of renewing their registration certificate.

According to Pest Control Products Act Cap 346.it requires an annual registration of each brand or grade of a pesticide before manufacturing, distributing, selling, offering for sale or offering for use

Only pesticide products that are renewed by the board for use in the current calendar year can be allowed for distribution, for sale,for manufacturing,for growing,and for food processing etc.

The Renewal of Pesticide is done annually and it expire on every December 31 of each year and must be renewed by the registrant for continued sales, distribution or use and must be renewed one month before expiration date. (this is according to the Pest Control Products Act, Cap 346, Laws of Kenya of 1982).
