Introduction

A certificate of absence of marriage record is a document certifying that you have not registered any marriage in Hong Kong.

Eligibility

If you need a document certifying that you have not registered any marriage in Hong Kong, you can apply for a Certificate of Absence of Marriage Record (“CAMR”). However, if the search result shows that you are not qualified for CAMR due to the fact that you have marriage record(s) in Hong Kong, a letter of marriage record indicating the date(s) of your previous marriage(s) will be issued.

Instructions

To apply for a CAMR, you have to complete an application form (Form MR35) and pay the prescribed fee for a search of marriage record.

You should bring along your Hong Kong identity card or valid travel document and submit your application in person to any of the marriage registries.

You may also choose to submit your application by post. The duly completed application form, a photocopy of your Hong Kong identity card and your travel document bearing your personal data and signature should be sent to the Marriage Registration and Records Office, 3/F, Low Block, Queensway Government Offices, 66 Queensway, Hong Kong together with the prescribed fee for a search of marriage record.

The signature on your application form must be the same as that on your travel document. If your travel document was issued in places outside Hong Kong, the photocopy of the travel document must be properly certified by a notary public. You may download an application form for Certificate of Absence of Marriage Record (MR35) via http://www.immd.gov.hk

Procedure

To apply for a certificate of absence of marriage record, you have to complete an application form and pay the prescribed fee for a search of marriage record.

If the search result shows that you have no marriage record in Hong Kong, you will be issued a certificate of absence of marriage record on payment of the prescribed fee. Otherwise, you will only be issued a letter of marriage record on which the date(s) of your previous marriage(s) will be indicated.

You can send your application in person, through an authorised representative or by post. In Person

If you apply in person, you can hand in the duly completed application form and produce the original of your Hong Kong identity card or valid travel document to a marriage registry. You also need to pay the fee for a search of marriage record upon application.

If you are outside Hong Kong or you are in Hong Kong but with evidence of not being able to apply in person, you can produce the duly completed application form through an authorised representative to a marriage registry with the requisite evidence, your authorisation letter, photocopies of your Hong Kong identitiy card and travel document bearing your personal data and signature. Your signature on the application form/authorisation letter must be the same as that on your travel document.

If your travel document was not issued by the Hong Kong Immigration Department, the photocopy of the travel document must be properly certified by a Notary Public.

Your authorised representative needs to pay the fee for a search of marriage record upon application.

By Post

If you want to apply by post, you can send the duly completed application form, a photocopy of your Hong Kong identity card and your travel document bearing your personal data and signature together with the necessary fees to:

Required Documents

  • If divorced, Decree Absolute.
  • If widowed, Death Certificate of previous spouse (and Marriage Certificate).
  • If your name has been changed by Deed Poll, proof is necessary.

Fees

Certificate of absence of marriage record : HK$680 (an addition of HK$70 when the certificate is required to be posted to an address outside Hong Kong plus the airmail postage at the normal rate if the certificate is to be sent by airmail)

Payment Methods Applying In Person

  • You should pay the prescribed fee for a search of marriage record upon application.
  • The fee for the issue of a certificate of absence of marriage record should be paid when you collect the certificate.
  • You can pay in cash, by EPS, a crossed cheque or a cashier order in Hong Kong currency payable to "The Government of the Hong Kong Special Administrative Region". Post dated cheques will not be accepted.

Applying By Post

  • You should send in the prescribed fee for a search of marriage record with your application.
  • If the search result shows that you have no marriage record in Hong Kong, you will be notified by post of paying the fee for the certificate of absence of marriage record.
  • You will also be notified of paying the additional charge and registered airmail postage if the certificate is to be posted to an address outside Hong Kong.
  • You can pay by a crossed cheque, bank draft or cashier order in Hong Kong currency drawn from a bank in Hong Kong payable to "The Government of the Hong Kong Special Administrative Region". Please do not send in cash with your application.

Processing Time

If all necessary documents and fees are received upon application, it normally takes nine working days (working days denote Monday to Friday excluding General Holidays) to process the application for a certificate of absence of marriage record, excluding the time of mail services (if any) for postal applications.

Collection of Certificate of Absence of Marriage Record

Applying In Person

On the date of application, you will be given a card notifying you of the date for collection of the search result. If the search result shows that you have no marriage record in Hong Kong, you will be issued a certificate of absence of marriage record after payment of the prescribed fee on the date of collection. Otherwise, you will only be issued a letter of marriage record.

You may either collect the letter of marriage record / certificate of absence of marriage record in person or authorise in writing a representative to do it on your behalf. The authorisation form can be obtained from a marriage registry. The signature on the authorisation form must be the same as that on your application form.

Applying By Post

If you apply by post and the result shows that you have no marriage record in Hong Kong, you will be notified by post of paying the fee(s) required for obtaining a certificate of absence of marriage record. The certificate will be posted to you at the mailing address indicated in the application form on receipt of the required fee(s).

If the search result shows that you have marriage record in Hong Kong, a letter of marriage record will be posted to you.

Other uses of the Document/Certificate

In order for non-nationals to marry in a foreign country you will most likely be required to produce legal documentation from your country of citizenship verifying single status and that you are free to marry. This is known as a 'Certificate of No Impediment', 'Certificate de Coutume', 'Certificate of Nulla Osta' or a 'Certificate of Freedom to Marry'.

On the date of application, you need to pay HK$140 for a search of marriage record. If the search result shows that you have no marriage record in Hong Kong, you will be issued a CAMR. The prescribed fee for the CAMR is HK$680. The fee will be collected upon collection of the CAMR. Payment can be made by cash, EPS, a crossed cheque or a cashier order in Hong Kong currency payable to "The Government of the Hong Kong Special Administrative Region". Post dated cheques will not be accepted.

If you have marriage record(s) in Hong Kong, you will be issued a letter of marriage record which is free of charge. For postal applications, you can send in a crossed cheque, bank draft or cashier order in Hong Kong currency drawn from a bank in Hong Kong payable to "The Government of the Hong Kong Special Administrative Region" together with the application for payment of a search of marriage record.

If the search result shows that you have no marriage record in Hong Kong, you will be notified by post for sending in the payment for the CAMR. An addition of HK$70 is payable if the certificate is required to be posted to an address outside Hong Kong and an airmail postage at the normal rate will be charged if the certificate is to be sent by airmail.
