A trademark is a sign / symbol that individualizes and differentiates the products or services of a given enterprise from the goods of others in the same market. A trademark may be a word, design, letter, number or packaging, slogan, device, symbol, hologram or sound among others. In order to register a trademark in Burundi, an applicant must apply for registration at The Burundi Trademarks Registrar


  • Any trader / enterprise can apply to register trademark; and
  • To be eligible to be registered, a trademark must be distinctive and should not be deceptive.

1.Ensure that all documents are submitted in French;

2.Documents that are not in French should be translated and certified by a notary;

3.Ensure that a chosen trademark is not similar to any other trader’s trademark;

4.Ensure that the chosen trademark is easy to pronounce, easy to spell and easy to remember if it’s a word;

5.A trademark must be easily to reproduce;

6.Ensure that a chosen trademark can be used worldwide;

7.Choose a trademark that will easily identify products;

8.Ensure that the chosen trademark is not deceitful or misleading and must not cause confusion to the public;

9.A submitted trademark must be in a format that makes the copy possible;

10.When a trademark is registered, officially registered and restricted to the owner;

11.A single application may be submitted to cater for a number of goods / services;

12.Endeavor to renew registration if it expires;

Required Information

1.Detailed identity of trademark owner (name, physical and contact address)

2.Description of the products or services the trademark is intended or is used with

3.Class or classes in which the registration is requested

4.Business registration number

5.Trademark name and class

6.Specification of the goods and services provided

7.Details of authorization of lawyer / agency


1.The applicant who wishes to register a trademark starts by finding one that is he / she thinks is appropriate and suits the goods / services he / she produces;

2.The applicant after getting a suitable trademark must then appoint a trademark service provider (an attorney / lawyer / notary or authorized agency) to assist and guide him / her through processes of registering the trademark;

3.When a service provide is appointed, he / she / it starts with carrying out a trademark comprehensive study to ensure that the chosen trademark meets the requirements of trademarks in Burundi. At this stage, the applicant together with appointed service provider carries out a trademark search and the truthiness of trademark is evaluated.

4.After the comprehensive study, a trademark is either found eligible or not. When found eligible, the applicant through the appointed service provider, prepares all the required documents and submits them together with application for registration to the Burundi Trademark Registrar;

5.The submitted documents are reviewed and assessed by the registrar and if there are no objections to the documents submitted, the trademark is registered and a certificate of registration is issued;

1.Identification documents of applicant

2.A copy of the trademark;

3.Ten (10) prints, even for word marks in ordinary type;

4.Business registration certificate;

5.Business trading license;

6.The Power of Attorney to appoint a trademark agent;

7.Translated trademarks (if original trademarks are not in French)

8.List of goods / services provided

9.Payment slips;

10.Original authorization documents and information sheet (if trademark was originally owned by another person)

11.A simply signed Power of attorney mentioning the name of the lawyer who will handle the procedure

12.A certified copy of the basic application (in cases where convention priority is claimed)


Fees vary basing on the service provider appointed. Below are estimated costs:

2.Registration proper of a trademark in one class – USD 400

Information which might help

Traders must note that in cases where one wishes to secure ownership of trademark worldwide, he /she is required to visit each and every country to register trademark separately.

This is so because trademarks have territorial rights thus protection is only obtained upon registration at the national registration and each country has its own rules and regulations, processing time and cost and other requirements relating to trademarks.
