1. Complete request form R5703 issued by the German Patent and Trade Mark Office. A link is provided under "Documents to Use" section which you can use to download the form.
2. Submit your application to the German Patent and Trade Mark Office in Jena. You can submit your application in person at the office's locations in Munich, Jena and Berlin. Some Patentinformationszentren (patent information centres) accept design applications for transmittal to the German Patent and Trade Mark Office.
3. Pay the application fee.
4. Once your application is received, it will be reviewed by the Designs Unit checking the application for any defects. The Unit will also check whether or not the design applied for is eligible for designs protection at all and whether the design complies with public policy and accepted principles of morality. The design must not constitute an improper use of any State emblems and other signs of public interest. If these requirements are met, the Design Unit will enter the design in the Designs Register. Note: The Designs Unit does not examine whether or not the design actually fulfills the substantial requirements for protection, that means whether it is in fact new and has individual character. In case of a dispute, these requirements are examined by the civil courts. However, if the requirements are not met at the date of filing the application - despite design registration - no IP right is created, from which rights might be derived.
5. The design registration will be published in the electronic designs gazette (Geschmackmusterblatt).

• Completed request form
• Representation of the design that is suitable for publication. The representation of the design can be glued to or printed on the representation form (pdf- Datei R5703.1), or filed as a JPEG file (*.jpg) on an electronic data carrier (CD or DVD).
• At least one product in which the design is incorporated or to which it is applied. You may search for the corresponding designations of goods online at Suchmaschine.

Payment Details

Design protection arises when the design is entered in the Designs Register. The protection can last for 25 years from the filing date.
